How many years of service in the police force are required to qualify for seniority allowance?
Based on Clause 1, Article 10 of Decree 49/2019/ND-CP, the regulation on seniority allowance is as follows:
Police workers who have served in the People's Police for a full 5 years (60 months) are entitled to a seniority allowance equal to 5% of their current salary, plus their leadership position allowance and excess seniority allowance (if any); From the sixth year onwards, each year (12 months) is calculated an additional 1%.
The seniority allowance is calculated and paid together with the monthly salary and is used to calculate contributions and benefits for social insurance, health insurance, unemployment insurance, and labor accident and occupational disease insurance.
Thus, according to the regulation, police officers who have been in the force for 5 years or more are eligible for the seniority allowance. Therefore, in your case, you do not meet the requirement.
Is time off exceeding the limit of social insurance considered for seniority allowance?
According to Clause 3, Article 10 of Decree 49/2019/ND-CP, the regulation on the periods not counted towards the seniority allowance is as follows:
Periods not counted for the allowance
- The period of taking personal leave without pay continuously from 01 month or more;
- The period of sick leave, maternity leave exceeding the limit stipulated by law on social insurance;
- The period of being temporarily suspended from work or detained, subsequently disciplined with dismissal.
Thus, in your case, the period you were on sick leave exceeding the limit stipulated by the law on social insurance will not be counted towards the seniority allowance.
