Has the Law on Organization of the Government of Vietnam 2025 officially promulgated?
On February 18, 2025, the National Assembly of the Socialist Republic of Vietnam passed the Law on Organization of the Government of Vietnam 2025.
Article 1 of the Law on Organization of the Government of Vietnam 2025 stipulates the position and functions of the Government of Vietnam, including:
- The Government of Vietnam is the highest state administrative body of the Socialist Republic of Vietnam, exercising executive power, and is the executive body of the National Assembly.
- The Government of Vietnam is responsible to the National Assembly and reports its work to the National Assembly, the Standing Committee of the National Assembly, and the President.
The Law on Organization of the Government of Vietnam 2025 takes effect from March 1, 2025.

What issues does the Government of Vietnam submit to the National Assembly for decision?
According to Article 10 of the Law on Organization of the Government of Vietnam 2025 on the duties and powers of the Government of Vietnam:
Article 10. Duties and powers of the Government of Vietnam
The Government of Vietnam performs duties and powers as stipulated by the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly, as well as the following specific duties and powers:
- Presenting to the National Assembly for decision:
a) Passing bills;
b) Passing bills or draft resolutions on: goals, targets, basic policies, and tasks for socio-economic development of the country; fundamental policies on national finance and currency; ethnic and religious policies of the State; basic foreign policies of the State; division of revenue and expenditure responsibilities between the central and local budgets; limits on national debt, public debt, and government debt; state budget estimates and central budget allocations; approval of state budget final accounts; referendum;

According to the above regulations, the Government of Vietnam presents the following issues to the National Assembly for decision:
- Passing bills
- Passing bills or draft resolutions on: goals, targets, basic policies, and tasks for socio-economic development of the country; fundamental policies on national finance and currency; ethnic and religious policies of the State; basic foreign policies of the State; division of revenue and expenditure responsibilities between the central and local budgets; limits on national debt, public debt, and government debt; state budget estimates and central budget allocations; approval of state budget final accounts; referendum
- Passing draft resolutions on the establishment, abolition of Ministries, ministerial-level agencies; establishment, dissolution, merger, division, adjustment of boundaries of provincial administrative units, special administrative-economic units
What contents does the Prime Minister of Vietnam issue decisions on?
According to Clause 6, Article 13 of the Law on Organization of the Government of Vietnam 2025, the Prime Minister of the Government of Vietnam issues decisions on the following contents:
- During the time when the National Assembly is not in session, deciding on appointing acting Ministers, heads of ministerial-level agencies in case of vacancies; during the period between two sessions of the provincial People's Councils, deciding on appointing acting Chairpersons of the provincial People's Committees in case of vacancies
- Appointing, dismissing, temporarily suspending, expelling, accepting the resignation of Deputy Ministers or equivalent positions in Ministries, ministerial-level agencies; deciding on appointing, dismissing, the head, deputy head of agencies under the Government of Vietnam and other titles according to the hierarchy of personnel management by the competent authority
- Approving the election, dismissal, and deciding on the transfer, expulsion of the Chairpersons, Vice-Chairpersons of the provincial People's Committees; temporarily suspending the provincial People's Committee Chairpersons; requiring the provincial People's Committee Chairpersons to temporarily suspend, expel as per personnel management hierarchy regarding the Vice-Chairperson of the provincial People's Committees, Chairpersons, Vice-Chairpersons of lower-level People's Committees when failing to fulfill tasks assigned by competent authority or violating the law
- Deciding on the establishment, reorganization, dissolution of other agencies, organizations under the provincial People's Committees as per legal regulations; deciding on the establishment of councils, committees, or panels when necessary to assist the Prime Minister of the Government of Vietnam in researching, directing, and coordinating in addressing important inter-sectoral issues
