The content of public employee management in Vietnam

According to Article 61 of Decree 115/2020/ND-CP on the content of public employee management, the following are regulated:

1. Developing plans and public employee planning.

2. Regulating professional title standards for public employees, determining job positions, public employee structure according to professional titles, and corresponding workforce.

3. Organizing recruitment, work contract signing, task assignment, special assignments, inspection, and evaluation of public employees.

4. Organizing changes in professional titles.

5. Organizing training and development regimes for public employees.

6. Organizing salary regimes and welfare policies for public employees.

7. Organizing commendation and disciplinary actions for public employees.

8. Handling resignations and retirements of public employees.

9. Implementing reporting, statistics, and management of public employee records.

10. Inspecting and examining the implementation of legal regulations on public employees.

11. Resolving complaints and denunciations against public employees.

Duties and powers of the Ministry of Home Affairs in Vietnam

Article 62 of Decree 115/2020/ND-CP regulates the duties and powers of the Ministry of Home Affairs as follows:

The Ministry of Home Affairs is responsible to the Government for performing the state management function on public employees, with the following duties and powers:

1. Developing, amending, and supplementing legal regulations on public employees to be submitted by the Government to the National Assembly and the Standing Committee of the National Assembly.

2. Developing proposals for the Government and the Prime Minister to regulate the strategy, planning, plans, and programs for the development of the public employee workforce; assigning and decentralizing the management of public employees; job positions and public employee structure according to professional titles; training and development strategies and plans for the public employee workforce; salary regimes; policies for talented individuals; regulations on appointments, reappointments, special assignments, retention of positions, dismissal, commendation, discipline, termination of work contracts, resignations, and retirements of public employees.

3. Guiding and inspecting the implementation of legal regulations on professional title standards for public employees; issuing regulations and rules on organization of recruitment examinations, public employee selection examinations, regulations and rules on organization of promotion examinations or assessments for professional title advancement of public employees; providing opinions on the framework training program according to professional title standards for public employees; regulating the application of public employee titles to job positions in administrative, general, office administration, personnel organization, planning, finance, and other job positions that do not hold professional titles and do not engage in professional activities of public career units.

4. Chairing and coordinating with specialized ministries, sectors, and localities in the management of records, record management; public employee identification numbers; public employee cards.

5. Chairing and coordinating with ministries, sectors, and localities in conducting statistics on the quantity and quality of the public employee workforce.

6. Providing opinions to ministries, sectors, and localities on standards, conditions for appointment to professional titles, and salary ranking for public employees holding professional title rank I.

7. Guiding and organizing the implementation of the reporting regime on public employee management.

8. Inspecting, examining, and supervising the implementation of legal regulations on public employees.
