Summary of Administrative Violations in the Field of Cryptography
Cryptographic activities are special classified activities, belonging to the field of national security, utilizing cryptographic operations, cryptographic techniques, and related solutions to protect state confidential information, performed by a specialized force.
In Clause 3 Article 1 of Decree 120/2013/ND-CP regulating the administrative sanctions in the field of national defense and cryptography issued by the Prime Minister of the Government of Vietnam, it is stipulated that administrative violations in the field of cryptography include:
- Violations of the regulations on the use of cryptographic products not provided by the Government of Vietnam's Cryptographic Department to protect information within the scope of state secrecy;
- Violations of regulations on state secrecy protection when transmitting confidential information via communication, telecommunication means, or storing confidential information with electronic or informational devices without encrypting with cryptography from the cryptographic department;
- Violations of regulations on the time frame not allowed to participate in cryptographic activities and regulations on the production and provision of cryptographic products to protect information within the scope of state secrecy.
Note: Administrative violations related to the field of cryptography stipulated in decrees regulating administrative sanctions in areas such as land; health; social insurance; transportation; construction; management, use of state assets; security, order, social safety, and other fields are sanctioned according to the provisions of those Decrees.
