Statement of Personal Information Including Criminal Record
Clause 1 Article 3 of Circular 36/2014/TT-BCA stipulates:
The Household Registration Declaration Form (denoted as HK01) is used for citizens aged 14 and above to declare in the following cases:
- When carrying out permanent residence registration or temporary residence registration procedures;- Citizens who have already registered permanent or temporary residence but have not yet filled out the Household Registration Declaration Form.
Thus, the Household Registration Declaration Form is used in accordance with Form HK01 issued together with Circular 36/2014/TT-BCA.
In section 20 of the Household Registration Declaration Form (Form HK01), there is the content:
- Criminal Record (Offense, penalty, according to judgment number, date, month, year of the Court):...............
Additionally, Clause 5 Article 8 of Circular 36/2014/TT-BCA provides guidance on how to fill out this section as follows:
Section "Previous Convictions and Administrative Sanctions": Clearly state the offense, penalty according to the judgment number, date, month, year of the Court; whether the record has been expunged or not, or is currently in the stage of prosecution, investigation, indictment, trial; whether the penalty has been or is being served; sentenced to imprisonment with a suspended sentence; additional penalties; whether or not subject to procedural preventive measures or subject to educational measures at the commune, ward, commune-level town, placement in reformatory schools; placement in compulsory education institutions and compulsory rehabilitation centers. Duration of the applied measure.
Thus, the household registration declaration form will contain information about previous convictions. You shall record information about previous convictions in accordance with the mentioned guidance.
