Six Cases of Full Salary Leave for Professional Soldiers

Due to the nature of work far from home, there is not much time for my wife and children, so I often take advantage of annual leave days. Could you please clarify how the law regulates the leave policies and entitlement to full salary for professional servicemen?Looking forward to your prompt response!

According to Circular 113/2016/TT-BQP, there are six cases in which professional soldiers are entitled to leave with full pay and allowances (if any) as stipulated by the Labor Code and the regulations of the Minister of Defense as follows:

Firstly, weekly leave.

Professionals, workers, and public employees in defense are entitled to weekly leave on Saturdays and Sundays. For units with special tasks that cannot take leave on Saturdays and Sundays, the authorized command unit can arrange compensatory leave for professionals, workers, and public employees in defense on another day of the week.

Secondly, annual leave.

- Less than 15 years of service are entitled to 20 days;

- From 15 years to less than 25 years of service are entitled to 25 days;

- From 25 years of service or more are entitled to 30 days.

- Prioritization:

+ Stationed more than 500 km away from family or on islands of the Truong Sa archipelago, DK are entitled to an additional 10 days per year;

+ Stationed between 300 km to less than 500 km away from family; stationed in remote, isolated areas, border areas between 200 km to less than 300 km from family, and currently receiving regional allowance with a coefficient from 0.5 to 0.7 or on islands with regional allowance coefficient from 0.1 to less than 1.0 are entitled to an additional 05 days per year.

Thirdly, special leave.

No more than 10 days, in the following cases:

  1. Marriage; legal adoptive or biological child’s marriage.

  2. Biological parents; parents-in-law; legal guardians of oneself, spouse, or such as wife or husband; biological children, legal adoptive children dying or seriously ill, injured requiring long treatment at medical facilities.

  3. Family suffers significant damage to life and property due to accidents, natural disasters, and dangerous epidemics.

Fourthly, holiday and festival leave.

- As stipulated in Clause 1, Article 115 of the Labor Code 2012.

- Vietnam People’s Army Foundation Day (December 22).

Fifthly, recuperation and rehabilitation leave.

Professional soldiers are entitled to recuperation and rehabilitation leave in accordance with Circular 179/2013/TT-BQP.

Sixthly, retirement preparation leave.

- From 20 to less than 25 years of social insurance contributions are entitled to 09 months;

- From 25 years of social insurance contributions or more are entitled to 12 months.

In addition to the leave policies mentioned above, professional soldiers are also entitled to sick leave, maternity leave policies as stipulated by the law on social insurance.
