Are single fathers raising 12-month-old children eligible for postponement from participation in militia and self-defense forces in Vietnam?
According to Clause 1, Article 11 of the Law on Militia and Self-defense Force 2019, the cases eligible for postponement from participation in militia and self-defense forces during peacetime in Vietnam are as follows:
1. A citizen shall be eligible for postponement from participation in militia and self-defense forces in case:
a) She is pregnant or raising a child under 36 months old; he is raising a child under 36 months old; or
b) He/she has inadequate health to perform tasks of militia and self-defense forces; or
c) He/she has a spouse who is an officer, professional servicemen, official, national defense employee, non-commissioned officer or soldier serving in the People’s Army; or
d) He/she has a spouse who is an officer, non-commissioned officer, soldier or policeman serving for People’s Public Security; or
dd) He/she has an official spouse or youth volunteer assigned to extremely disadvantaged socio-economic area according the law provisions; or

Under the current provisions, single fathers raising 12-month-old children are eligible for postponement from participation in militia and self-defense forces in Vietnam.
Which authority has the competence to decide on citizens participating in militia and self-defense forces in Vietnam?
Article 10 of the Law on Militia and Self-defense Force 2019 stipulates the authority to decide on citizens' obligation to participate in the militia as follows:
3. Reservists who have not been conscripted for reserve forces shall be selected for militia and self-defense forces.
4. Chairpersons of People’s Committees of communes and districts that do not have communes, heads of agencies and organizations shall decide which citizens to participate in militia and self-defense forces.
5. Minister of National Defense shall elaborate Clause 1 of this Article.
The Chairpersons of People’s Committees of communes will decide on citizens participating in militia and self-defense forces in Vietnam.
