Responsibilities of the Certifier and the Recipient when Certifying Copies from Original Documents
At Article 11 of Circular 01/2020/TT-BTP, there are regulations regarding the authority to annul documents and papers that have been authenticated not in accordance with the law as follows:
- The person performing authentication (in cases where the authentication officer receives the application) and the person receiving the application at the one-stop-shop, interconnected one-stop department are responsible for checking and comparing the copy with the original and ensuring that only authenticated copies are made after the comparison with the original has been correct.
- If the original is found to fall under one of the cases stipulated in Article 22 of Decree No. 23/2015/ND-CP, the authentication agency shall refuse to accept the application. In cases where the requester for authentication uses an original that is erased, added to, falsified in content, uses fake documents, or where the copy’s content does not match the original, the person receiving and handling the application shall make a violation record, retain the application to propose the competent authority to handle in accordance with legal regulations.
