Responsibilities of Complainants, Accusers, and Respondents Regarding the Practice of Democracy in the Resolution of Complaints and Accusations as Prescribed by Law
Please provide clarification on the legal responsibilities of complainants, accusers, and those being complained or accused about the exercise of democracy in handling complaints and accusations.Responsibilities of Complainants and Accusers in Implementing Democracy in the Settlement of Complaints and Denunciations
Based on Article 10 of Circular 117/2021/TT-BCA, the responsibilities of complainants and accusers in implementing democracy in the settlement of complaints and denunciations are as follows:
Complaints and denunciations must be conducted in accordance with the law on complaints and denunciations.
Assume legal responsibility for exploiting the rights of complaints and denunciations to make false complaints or denunciations, or for acts that infringe on the interests of the State, the legal rights and interests of agencies, organizations, individuals; or for acts of distortion, slander, and offending the honor, dignity, and reputation of agencies, organizations, and other individuals.
Present identification documents, provide information and materials related to the content of the complaint or denunciation when required by the competent authority, and bear responsibility for the information and materials provided.
Implement the requests of the Verification Team, Verification Group during the process of verifying and concluding the content of the complaint or denunciation in accordance with the law.
Rights and Responsibilities of the Accused in Implementing Democracy in the Settlement of Complaints and Denunciations
Based on Article 11 of this Circular, the rights and responsibilities of the accused in implementing democracy in the settlement of complaints and denunciations are as follows:
The accused has the rights as stipulated by the Law on Complaints, the Law on Denunciations, and the guiding documents for their implementation.
Comply with verification decisions and conclusions on the content of complaints and denunciations by competent authorities in the People's Public Security.
Be present at the specified time and place as required by the Verification Team, Verification Group.
Report and explain the content of the complaints or denunciations as required by the Verification Team, Verification Group, and bear legal responsibility for the reported and explained content.
Promptly and fully provide information and materials related to the content of the complaints or denunciations as required by the Verification Team, Verification Group.
Comply with complaint resolution decisions and recommendations according to the handling decisions of the heads of competent authorities in the People's Public Security.
