Resolution of Complaints Outside the Jurisdiction of the Court from October This Year
Based on Clause 3, Article 9 of Circular 01/2020/TT-TANDTC (effective from August 20, 2020), when receiving complaints that are not within the Court's jurisdiction to resolve, the Court shall proceed as follows:
- For complaints that are not under the Court's jurisdiction, within 05 working days from the date of receipt of the complaint, the handler shall propose that the competent authority issue a notification to return the complaint and guide the complainant to submit the complaint or directly present it to the authority, organization, or unit that has the jurisdiction to resolve it;
- For complaints forwarded by National Assembly delegates, People's Council delegates, the Vietnam Fatherland Front Committee and its members, press agencies, or other entities as prescribed by law but are not within the Court's jurisdiction to resolve, within 05 working days from the date of receipt of the complaint, the handler shall propose that the competent authority issue an official dispatch returning the complaint, clearly stating the reasons for the return to the authority, organization, or individual that forwarded the complaint.
