Resolution 38 on the Adjustment of the 2023 Law and Ordinance Development Program in Vietnam
Recently, the Standing Committee of the National Assembly of Vietnam issued Resolution 38/2023/NQ-UBTVQH15 on the adjustment of the 2023 Law and Ordinance Development Program.
The Resolution adjusts the 2023 Law and Ordinance Development Program to include the following item:
Adding to the 2023 Law and Ordinance Development Program to submit to the National Assembly for comments and approval at the 6th session (October 2023) according to the process at a session of the draft Resolution of the National Assembly piloting a number of specific mechanisms and policies on investment in the construction of road traffic works.
Therefore, the 2023 Law and Ordinance Development Program will add a pilot program for some special mechanisms and policies for investment in the construction of road infrastructure to be submitted to the National Assembly for consideration and approval at the 6th session (October 2023) in accordance with the one-session procedure for the draft resolution of the National Assembly.
In addition, the following responsibilities will be assigned:
- The Government will be responsible for submitting the draft resolution.
- The National Assembly's Committee on Economic Affairs will be responsible for leading the review.
- The National Assembly's Ethnic Council and other committees will participate in the review of the draft resolution of the National Assembly on pilot testing some special mechanisms and policies for investment in the construction of road infrastructure.

When will the 6th session of the 15th National Assembly in Vietnam take place?
According to the plan, the 6th session of the 15th National Assembly will take place from October 23 to November 28, 2023, with a total working time of 22 days.
The session will be held in two phases:
- Phase 1: 15 days (from October 23 to November 10, 2023)
- Phase 2: 7 days (from November 20 to November 28, 2023)
Location: The 6th session of the 15th National Assembly will be held in a plenary session at the National Assembly in Hanoi.
What are procedures for the program of the National Assembly session in Vietnam?
Pursuant to Clause 4 and 5, Article 6 of the Regulation of the National Assembly Sessions issued together with Resolution 71/2022/QH15 stipulating procedures for the program of the National Assembly session in Vietnam as follows:
Program of National Assembly Sessions
1. Based on the laws, resolutions of the National Assembly, legal instruments, resolutions of the Standing Committee of the National Assembly, proposals from the President of the Socialist Republic of Vietnam, the Prime Minister, the Central Committee of the Vietnam Fatherland Front, the Chief Justice of the Supreme People's Court, the Prosecutor General of the Supreme People's Procuracy, the Supreme Audit Office, the National Assembly Ethnic Councils, the National Assembly Committees, and Members of the National Assembly, the Standing Committee of the National Assembly shall draft the program of the National Assembly session.
2. The drafting of the program of the National Assembly session shall ensure that it is in line with the practical requirements; in which, priority shall be given to scheduling time for discussing draft laws and resolutions submitted to the National Assembly for approval at the previous session before draft laws and resolutions submitted to the National Assembly for consideration; the economic and social discussion session shall be held before the questioning session; and contents in related fields shall be scheduled for discussion close together.
3. The draft program of the National Assembly session shall be sent to the Members of the National Assembly, relevant agencies and organizations for their opinions no later than 30 days before the opening of the session for the regular session and no later than 7 days before the opening of the session for the extraordinary session.
4. The program of the National Assembly session shall be reviewed and approved by the National Assembly at the preliminary meeting in the following order:
a) The Standing Committee of the National Assembly shall report on the explanation, reception, and revision of the draft program of the National Assembly session.
At the first session of each National Assembly term, the Standing Committee of the previous National Assembly term shall report on the explanation, reception, and revision of the draft program of the National Assembly session.
b) The National Assembly shall review and approve the program of the National Assembly session.
5. In case of necessity, based on proposals from the President of the Socialist Republic of Vietnam, the Prime Minister, the Central Committee of the Vietnam Fatherland Front, the Chief Justice of the Supreme People's Court, the Prosecutor General of the Supreme People's Procuracy, the Supreme Audit Office, the National Assembly Ethnic Councils, the National Assembly Committees, and Members of the National Assembly, the Standing Committee of the National Assembly shall submit to the National Assembly for consideration and decision on the revision and supplementation of the program of the National Assembly session in the following order:
a) The Standing Committee of the National Assembly shall submit to the National Assembly the revision and supplementation of the program of the National Assembly session.
b) The National Assembly shall review and approve the revision and supplementation of the program of the National Assembly session.
6. In case of necessity to adjust the time for implementing the contents of the National Assembly session, the broadcasting and live broadcasting of the plenary session of the National Assembly in the program of the session that has been approved by the National Assembly, the Standing Committee of the National Assembly shall decide and report to the National Assembly.
Therefore, the program of the National Assembly session is carried out in the following order:
(1) For the program of the National Assembly session to be reviewed and approved by the National Assembly at the preliminary meeting:
- The Standing Committee of the National Assembly reports on the explanation, reception, and revision of the draft program of the National Assembly session.
- At the first session of each National Assembly term, the Standing Committee of the previous National Assembly term reports on the explanation, reception, and revision of the draft program of the National Assembly session;
- The National Assembly reviews and approves the program of the National Assembly session.
(2) If necessary, based on proposals from the President of the Socialist Republic of Vietnam, the Prime Minister, the Central Committee of the Vietnam Fatherland Front, the Chief Justice of the Supreme People's Court, the Prosecutor General of the Supreme People's Procuracy, the Supreme Audit Office; the National Assembly Ethnic Councils, the National Assembly Committees and Members of the National Assembly, the Standing Committee of the National Assembly shall submit to the National Assembly for consideration and decision on the revision and supplementation of the program of the National Assembly session, as follows:
- The Standing Committee of the National Assembly submits to the National Assembly the revision and supplementation of the program of the National Assembly session;
- The National Assembly reviews and approves the revision and supplementation of the program of the National Assembly session.
