Reproduction of documents in the People's Court system in Vietnam
Based on Clause 1 Article 21 of the Regulations on Document Management in the People's Court system issued together with Decision 01/QD-TANDTC in 2022, the reproduction of documents in the People's Court system is regulated as follows:
- The quantity of documents to be reproduced for distribution is determined based on the number of individuals and units at the receiving location of the document. If the document is sent to multiple locations and the list is not fully listed in the document, the drafting unit must have an appendix for the receiving location to be kept in the Court's archives.
- The receiving location must be specifically identified in the document, following the principle of only sending to the competent authority or unit responsible for resolving, coordinating, reporting, supervising, and inspecting matters related to the content of the document. It should not be sent to higher levels, multiple copies should not be sent to one recipient, and it should not be sent to other recipients just for information or reference.
- Maintain the confidentiality of the document content and reproduce it within the prescribed time frame.
- Reproduce classified documents (in accordance with the provisions of Article 15, Clause 3 of these Regulations). The Court's seal and the classified level and urgency level of the document are determined.
Court's seal for documents in the People's Court system in Vietnam
Based on Clause 2 Article 21 of the Regulations, the Court's seal for documents in the People's Court system is regulated as follows:
- When sealing over a signature, the seal must cover about 1/3 of the signature on the left side.
- The seal must be clear, neat, in the right direction, and use fresh red ink as prescribed.
- Seal on the attached appendix.
+ Sealing on the attached appendix is decided by the person signing the document. The attached appendix must have the signature of the person signing the document.
+ The attached appendices, tables, trust evaluation forms, assessment forms, etc., of the subjects, are sealed on the first page, covering part of the name of the agency, organization, or the name of the appendix clearly stating which document the appendix is attached to.
+ Sealing on the signature and the attached appendix is carried out according to the provisions of Decree 30/2020/ND-CP on document management.
- Overlapping seal and raised seal on the document for specialized documents and attached appendices are carried out according to the provisions of Article 33 of Decree 30/2020/ND-CP on document management.
+ The overlapping seal is placed in the middle of the right edge of the document or appendix, covering part of the pages, with a maximum of 5 pages per seal.
+ The overlapping seal is applied to important documents with at least 2 or more pages (litigation documents, economic contracts, etc.).
Sealing of urgency and classified level for documents in the People's Court system in Vietnam
Based on Clause 3 Article 21 of the Regulations, the sealing of urgency and classified level for documents in the People's Court system is regulated as follows:
- The sealing of urgency level and the position of the urgency seal (URGENT, VERY URGENT, EMERGENCY, SCHEDULED EMERGENCY) on administrative documents is sealed in box 10b as instructed in Section IV, Appendix I of Decree 30/2020/ND-CP dated March 5, 2020, by the Prime Minister, regarding document management.
- The sealing of classified levels (TOP SECRET, SECRET, or CONFIDENTIAL) and the "Recalled Document" seal (pre-engraved seal) is pre-engraved according to the regulations on state secret protection. The seal indicating the classified level is sealed in box 10a as instructed in Section IV, Appendix I of Decree 30/2020/ND-CP dated March 5, 2020, by the Prime Minister, regarding document management.
