Report Electric Fishing Activities to Whom?
Pursuant to the regulations in Clause 1, Article 28 of Decree 42/2019/ND-CP, the act of using electric shock tools to exploit aquatic resources, in cases where fishing vessels are not used, will be fined from VND 3,000,000 to VND 5,000,000.
Simultaneously, based on the regulations on the authority to sanction administrative violations in the field of fisheries from Article 46 to Article 53, with the above fine level, the persons authorized to sanction this act will include the following entities:
- Chairman of the Commune People's Committee;- Chairman of the District People's Committee;- Chairman of the Provincial People's Committee;
And other entities authorized to sanction administrative violations in the fisheries sector with a fine level of up to VND 5 million.
Regarding the responsibility to report violations, Clause 3, Article 14 of the Law on Handling of Administrative Violations 2012 stipulates:
Individuals and organizations are responsible for detecting, reporting, and combating administrative violations.
Therefore, in case of detecting the act of using electric shock tools to catch fish, you have the responsibility to report it to the authorized person for sanctioning. For convenience, you can report to the Commune or District People's Committee where the violation occurs to be received and handled according to regulations.
