On December 27, 2023, the Minister of Defense of Vietnam issued Circular 143/2023/TT-BQP (effective from February 15, 2024) on principles, time limits, and deadlines; forms and authorities of disciplinary action; acts of violation and application of disciplinary measures; and procedures for disciplinary action against persons who violate military discipline and state law in the Vietnam People's Army.
Article 2 of Circular 143/2023/TT-BQP provides as follows:
Subjects of application
1. Officers, professional soldiers, non-commissioned officers, soldiers (hereinafter collectively referred to as military personnel), civil servants, public employees, and works of the Vietnam People's Army (hereinafter collectively referred to as civil servants, public employees, and workers of the Vietnam People's Army); relevant agencies, units, organizations, and individuals.
2. Persons working in organizations of the State Secret Service under the management of the Minister of Defense (hereinafter referred to as persons working in organizations of the State Cipher).
3. Contract workers currently serving in agencies and units under the Ministry of Defense, the State Cipher.
4. Reserve soldiers during the period of concentrated training, exercises, mobilization readiness checks, combat readiness, or performing tasks related to military and defense tasks.

As regulations above, the Circular on disciplinary action in the Vietnam People's Army applies to the following subjects:
- Officers, professional soldiers, non-commissioned officers, soldiers (hereinafter collectively referred to as military personnel), civil servants, public employees, and workers of the Vietnam People's Army (hereinafter collectively referred to as civil servants, public employees, and workers of the Vietnam People's Army); relevant agencies, units, organizations, and individuals.
- Persons working in organizations of the State Cipher under the management of the Minister of Defense (hereinafter referred to as persons working in organizations of the State Cipher).
- Contract workers currently serving in agencies and units under the Ministry of Defense, the State Cipher.
- Reserve soldiers during the period of concentrated training, exercises, mobilization readiness checks, combat readiness, or performing tasks related to military and defense tasks.
- Militia and self-defense forces affiliated with the Vietnam People's Army in combat, supporting combat, being trained at military training institutions, during concentrated training, or performing tasks related to military and defense tasks in accordance with the law.
- Reserve officer cadets training at military training institutions; citizens conscripted into the Vietnam People's Army.
- Persons who have ceased to serve in the Vietnam People's Army, ceased to work in organizations of the State Secret Service under the management of the Minister of Defense, but violated discipline during their time in service or work to the extent that disciplinary action is required.

What disciplinary measures will be applied in the Vietnam People's Army from February 15, 2024?
Article 11 of Circular 143/2023/TT-BQP (effective from February 15, 2024) provides for the following disciplinary measures in the Vietnam People's Army:
(1) Disciplinary measures for officers:
- Reprimand
- Warning
- Reduction in salary
- Demotion in rank
- Removal from office
- Reduction in military rank
- Deprivation of military rank of officer
- Deprivation of military status
(2) Disciplinary measures for professional soldiers:
- Reprimand
- Warning
- Demotion in rank
- Removal from office
- Reduction in salary
- Reduction in military rank
- Deprivation of military status
(3) Disciplinary measures for non-commissioned officers and soldiers:
- Reprimand
- Warning
- Demotion in rank
- Removal from office
- Reduction in military rank
- Deprivation of military status
(4) Disciplinary measures for civil servants, public employees, and workers of the Vietnam People's Army:
- Reprimand
- Warning
- Reduction in salary
- Demotion in rank
- Removal from office
- Termination of employment
Hanoi Capital Command has the authority to handle disciplinary violations in the Vietnam People's Army under its management
According to Article 12 of Circular 143/2023/TT-BQP, the Hanoi Capital Command has the authority to handle disciplinary violations committed by members of units under its command. Specifically:
- Reprimand: Up to the rank of division commander, political commissar of the division; commander, political commissar of the Vietnam Coast Guard region and equivalent.
- Warning: Up to the rank of regimental commander, brigade commander, political commissar of the regiment, brigade and equivalent; officers up to the rank of colonel; professional soldiers up to the rank of lieutenant colonel; civil servants, public employees, and civil servants of the Vietnam People's Army. Except for the following positions: division commander, political commissar of the division; commander, political commissar of the Vietnam Coast Guard region and equivalent.
- Demotion in rank, removal from office: Up to the rank of deputy regimental commander, deputy brigade commander, deputy political commissar of the regiment, brigade and equivalent.
- Reduction in salary, reduction in military rank of officer: Up to the rank of major; professional soldiers, civil servants, public employees, and civil servants of the Vietnam People's Army under the authority to raise salaries according to the regulations of the Ministry of Defense.
Note: Circular 16/2020/TT-BQP will expire on February 15, 2024.
