Promulgation of Decree 164/2024/ND-CP stipulating the organization and operation of the People's Public Security Inspectorate in Vietnam
On December 25, 2024, the Government of Vietnam promulgated Decree 164/2024/ND-CP regulating the organization and operation of the People's Public Security Inspectorate.
Decree 164/2024/ND-CP applies to the following entities:
- Government management agencies, Heads of government management agencies
- Units under the Ministry of Public Security and the Police of centrally administered provinces and cities
- Agencies performing the inspection function and Heads of agencies performing the inspection function of the People's Public Security
- Inspectors, professional inspection officers, part-time inspection officers
- Head of the inspection team, members of the inspection team of the People's Public Security
- Inspection subjects and agencies, organizations, individuals related to inspection activities of the People's Public Security.
Decree 164/2024/ND-CP takes effect from February 10, 2025.

Which agencies shall perform the function of the People's Public Security Inspectorate?
According to Article 7 of Decree 164/2024/ND-CP, the agencies performing the function of the People's Public Security Inspectorate include:
[1] The People's Public Security Inspectorate includes:
- Inspectorate of the Ministry of Public Security (hereinafter referred to as the Inspectorate of the Ministry)
- Inspectorate of the Police of provinces and central-affiliated cities (hereinafter referred to as the Provincial Police Inspectorate)
- Inspectorate of the Department of Prison Management, compulsory education centers, reformatory schools; Inspectorate of the Department of Firefighting and Rescue Police (hereinafter referred to as the Department Inspectorate).
[2] The District Police, district-level town, urban district, provincial city, city under the centrally-administered city, and Police units with personnel of 200 officers or more, arrange professional inspection officers; Police units with personnel below 200 officers, arrange part-time inspection officers.
Note: The number of professional inspection officers and part-time inspection officers in the units is decided by the Head of the unit.
What is the highest rank for the position of the People's Public Security officer in Vietnam?
Based on Article 25 of the Law on People's Public Security 2018 (amended by Clause 1, Article 2 of the Amended Law on Officers of the Vietnam People's Army 2024), the highest rank for the position and title of the People's Public Security officer is regulated as follows:
Article 25. Highest rank for the position and title of the People's Public Security officer
- The highest rank for the position of the People's Public Security officer is regulated as follows:
a) General: Minister of Public Security;
b) Senior Lieutenant General, not exceeding 07 in total, including:
Deputy Minister of Public Security, not exceeding 06;
Seconded People's Public Security officer elected to hold the position of Chairman of the National Defense and Security Committee of the National Assembly;
c) Positions and titles with the highest rank as Lieutenant General, Major General, not exceeding 197.
- The Government of Vietnam regulates positions and titles with the highest rank as Lieutenant General, Major General, the criteria, standards to consider promotion to higher ranks for officer grades and the highest rank for the newly established units, restructured units, and units with additional functions and tasks but not exceeding the maximum number of officer positions according to decisions from authorized levels.
- A seconded People's Public Security officer having positions, titles higher than positions, titles with the highest rank as Lieutenant General, Major General and special cases granted, promoted to officer grades are decided by the competent authority.
- The highest rank for positions, titles of an officer as senior to lower ranks is regulated by the Minister of Public Security.
The highest rank for the position of the People's Public Security officer is regulated as follows:
- General: Minister of Public Security
- Senior Lieutenant General, no more than 07, including
+ Deputy Minister of Public Security, no more than 06
+ Seconded People's Public Security officer elected to hold the position of Chairman of the National Defense and Security Committee of the National Assembly
- Positions and titles with the highest rank as Lieutenant General, Major General, not exceeding 197.
