Process of Appointing Official Leaders and Managers under the Management of Ministries, Sectors, and Localities from External Human Resources

Appointment of officials to leadership and management positions under the management of Ministries, sectors, and localities, when the personnel source is from other places, shall follow what procedure?

Procedure for the appointment of officials in leadership and management positions under the management of ministries, sectors, and localities, as human resources from other sources as stipulated in Clause 3, Article 46 of Decree 138/2020/ND-CP. To be specific: as follows:

- In the case of personnel proposed by an agency or organization, the collective leadership of the agency or organization shall discuss, agree on the policy and carry out the following tasks:

Meet with the personnel proposed for appointment to exchange views on the requirements of the job tasks.

Exchange views with the collective leadership and party committee of the agency or organization where the personnel proposed for appointment is working about the policy of transfer; obtain comments and evaluations from the collective leadership and party committee of the agency or organization regarding the personnel; review dossiers, verify backgrounds.

Discuss, comment, evaluate, and vote on the personnel by secret ballot. The personnel recommended for appointment must achieve a consensus of more than 50% of the total members of the collective leadership; in cases where the personnel achieves 50%, the decision will be made by the head; simultaneously, report all differing opinions for the competent authority to consider and decide.

Issue the appointment decision according to authority or submit it to the competent authority for consideration and decision.

- In the case of personnel proposed by the higher authority for transfer and appointment from external human resources to the agency or organization, the advising authority on personnel organization of the higher authority intending to transfer and appoint will carry out the following tasks:

Exchange views with the collective leadership and party committee of the receiving agency or organization regarding the proposed transfer and appointment.

Exchange views with the collective leadership and party committee of the agency or organization where the personnel is currently working regarding the policy of transfer and appointment; obtain comments and evaluations from the collective leadership and party committee of the agency or organization; review dossiers, verify backgrounds.

Meet with the personnel proposed for transfer and appointment to exchange views on the requirements of the job tasks.

Preside over and cooperate with relevant agencies to appraise the personnel.

Issue the appointment decision according to authority or submit it to the competent authority for consideration and decision.
