Principles for Receiving Policies for Persons Engaged in Resistance Activities Affected by Toxic Chemicals
According to Article 58 of Decree 131/2021/ND-CP (Effective from February 15, 2022), the principles for receiving policies for persons engaged in resistance activities affected by toxic chemicals are as follows:
- In cases where an individual is receiving war invalids' allowances, if they meet the conditions, they will also be entitled to additional allowances for those engaged in resistance activities affected by toxic chemicals.
- In cases where an individual is simultaneously receiving both war invalids' and sick soldiers' allowances, if they meet the conditions, they will receive allowances for those engaged in resistance activities affected by toxic chemicals as specified in Points b, c, d, Clause 1, Article 30 of the Ordinance.
- In cases where an individual is receiving a monthly allowance corresponding to a body injury rate of 81% or higher, but the records do not have a medical examination certificate or the certificate is not conformable, they will not receive policies for service allowances or special allowances; other preferential policies are enjoyed similarly as for those with a body injury rate of 81% or higher.
Time of Receiving Policies for Persons Engaged in Resistance Activities Affected by Toxic Chemicals
Based on Article 59 of Decree 131/2021/ND-CP (Effective from February 15, 2022), the timing for receiving policies for persons engaged in resistance activities affected by toxic chemicals is as follows:
- Persons engaged in resistance activities affected by toxic chemicals, and their biological children are entitled to monthly allowances and subsidies from the month when the competent medical assessment council issues the medical examination certificate.
- Persons engaged in resistance activities affected by toxic chemicals, who are recognized according to Clause 2, Clause 3, Article 56 of this Decree, are entitled to monthly allowances from the month when the Department of Labor, War Invalids, and Social Affairs issues the decision on preferential allowances.
