What are principles of assigning functions, tasks and powers of organizations of the Department and Office of the Ministry of Transport of Vietnam?

Pursuant to Article 2 of the Decision 1332/QĐ-BGTVT in 2022 stipulating principles of assigning functions, tasks and powers of organizations of the Department and Office of the Ministry of Transport of Vietnam as follows:

1. Ensure the full performance of the State management functions and tasks of the Ministry of Transport (hereinafter referred to as the Ministry).

2. Inherit the effective and reasonable assignment of functions, tasks and powers of organizations.

3. Assign a particular work to only one organization to act as the focal point for monitoring and handling; In case the document to be handled is related to the tasks of many organizations, the organizations shall jointly handle it and assign an organization related to the most specialized work to act as the focal point for summarization and submission according to regulations. The organization assigned to take charge of handling and settling the work must coordinate with other organizations and relevant agencies and units, and take responsibility for the final results of the assigned work before the leadership of the Ministry.

In case there are different opinions between organizations on the general focal point, the Ministry's leadership shall decide to assign an organization with appropriate tasks to act as the focal point for summarization and submit it according to regulations.

The organization assigned to synthesize and submit is responsible for honestly and fully synthesizing participating opinions. Opinions from organizations must be specific, focused on their areas of expertise, and sent on time as prescribed.

In case there are different opinions on the delivery of documents to organizations, they shall be settled according to the Regulation on receiving, handling and promulgating documents of the Ministry.

4. Assign work in accordance with the Working Regulations of the Ministry.

5. Heads of organizations are responsible for directing, urging, monitoring and inspecting civil servants, and promptly handling work according to regulations. In case of any problems, they must promptly report them to the Minister or Deputy Minister in charge for handling.

6. Responsible organizations are the focal point to assist the Minister in working relations with ministries, branches, localities and agencies, organizations and individuals in the fields within the scope of the organization's functions and tasks.

What are general functions, tasks and powers of organizations, departments and offices under the Ministry of Transport of Vietnam?

Pursuant to Article 3 of the Decision 1332/QĐ-BGTVT in 2022 stipulating general functions, tasks and powers of organizations, departments and offices under the Ministry of Transport of Vietnam as follows:

Within the scope of their assigned functions, tasks and powers, organizations are responsible for:

1. Assume the prime responsibility for advising the Minister to submit to competent authorities for promulgation or promulgate according to his/her competence legal documents, mechanisms and policies; guide, monitor and urge the implementation.

2. Regarding the inspection:

a) Regularly monitor, urge and inspect the implementation of documents and directives and opinions of the Government and the Prime Minister;

b) Help the Minister monitor the law enforcement situation and inspect the implementation of the law on transportation;

c) Organize regular and irregular inspections to serve the direction and administration requirements of the ministry's leaders.

3. Advise and assist the Minister in performing the duties of the standing agency of the inter-branch coordination organization. Coordinating work with relevant agencies and units inside and outside the Ministry to perform assigned tasks.

4. Coordinate with the Department of Organization and Personnel in recruitment; implementation of regimes and policies; the training and retraining of civil servants and employees under the management of the organization.

5. Assume the prime responsibility for, and coordinate with the Department of Organization and Personnel in building employment positions, civil servant rank structure, and managing, assessing and classifying civil servants and employees of the organization.

6. Coordinate with the Office of the Ministry and the Department of Organization and Personnel in performing the work of social insurance, health insurance, and settlement of sickness, maternity, occupational accident and occupational disease regimes for public employees and organization's employees.

7. Coordinate with the Ministry's Office, Information Technology Center and related organizations to receive, process, issue, exploit, manage documents and update databases on the Portal. Set.

8. Manage dossiers and documents, submit and store according to the provisions of law.

9. Participate in and guide the organization of research, application of science and technology, international cooperation.

10. Review, systematize and consolidate legal documents on transportation within the scope of responsibility of the organization.

11. Synthesize and make regular and irregular statistical reports as prescribed.

12. Request agencies and units under the Ministry and the Services of Transport to provide necessary documents and data to perform assigned tasks.

13. Assume the prime responsibility for implementing inspection, examination, audit and supervision conclusions related to the tasks of their units; propose a form of handling responsibility for organizations and individuals under the management of the Ministry that have errors according to the inspection, examination and audit conclusions when assigned by the leadership of the Ministry.

14. Carry out administrative reform as assigned by the Minister.

15. Perform specific functions, tasks and powers specified in Chapter II of this Decision.

What are regulations on organizational structure of departments under the Ministry of Transport in Vietnam?

Pursuant to Clause 1 Article 4 of the Decision 1332/QĐ-BGTVT in 2022 stipulating organizational structure of departments under the Ministry of Transport in Vietnam as follows:

1. Departments

The organizational structure includes: Director, Deputy Director and civil servants decided by the Minister in the total administrative staff of the Ministry assigned. The Director is appointed and dismissed by the Minister. The Deputy Director is appointed and dismissed by the Minister at the proposal of the Director.
