Official Adoption of the Latest 2024 Capital Law Effective from January 1, 2025
On June 28, 2024, the 2024 Capital Law was passed by the 15th National Assembly in its 7th session. The 2024 Capital Law, which governs the position and role of the capital; policies, responsibilities for building, developing, managing, and protecting the Capital, will take effect from January 1, 2025.
Article 2 of the 2024 Capital Law provides specific regulations on the position and role of the Capital as follows:
- The capital of the Socialist Republic of Vietnam is Hanoi.
- The Capital is the national political-administrative center, hosting the headquarters of central agencies of the Communist Party, the State, and socio-political organizations, diplomatic missions, international organizations; it is a centrally governed city, a special-class urban area, a major center for the country's economy, culture, education, training, science, technology, and international integration.
- The headquarters of central agencies of the Communist Party, National Assembly, President, and the Government of Vietnam are located in the Ba Dinh area of Hanoi.

Under What Conditions is the Title of Honorary Citizen of the Capital Awarded?
According to Article 7 of the 2024 Capital Law, the Title of Honorary Citizen of the Capital is regulated as follows:
Title of Honorary Citizen of the Capital
The Title of Honorary Citizen of the Capital is awarded to foreigners with special contributions to the construction, development, management, and protection of the Capital or particularly in establishing, expanding, and strengthening the solidarity, friendship, and international cooperation of the Capital.
The People's Council of Hanoi city shall stipulate the conditions, procedures for awarding, and revoking the Title of Honorary Citizen of the Capital, as provided in clause 1 of this Article.
Thus, the Title of Honorary Citizen of the Capital is awarded to foreigners who have made special contributions to the construction, development, management, and protection of the Capital or in establishing, expanding, and strengthening solidarity, friendship, and international cooperation of the Capital.
What Tasks and Authorities are Assigned to the People's Committee of Hanoi?
According to Article 10 of the 2024 Capital Law, the People's Committee of the city is assigned the following tasks and authorities:

The People's Committee of the City is assigned the following tasks and authorities:
Prepare and present to the People's Council of the City the decisions regarding the contents specified at points c, d, dd, and e of clause 4 of Article 9 of this Law; submit to the Standing Board of the People's Council the decisions on the contents specified in clause 5 of Article 9 of this Law;
Regulate the adjustment of job positions, official ranks, the structure of public employees according to job titles to fit the functions, tasks, authorities, and organizational structure of agencies, organizations, units under its management;
Based on principles, conditions, criteria for establishing public service providers as regulated by law, decide to establish new public service providers under the management of the People’s Committee of the City according to procedures set by the People's Council of the City;
Other tasks and authorities as regulated by this Law.
Thus, the People's Committee of Hanoi city is authorized to perform the following tasks and authorities:
- Prepare and present to the People's Council of the City decisions on the following contents:
+ Decide on the establishment, reorganization, dissolution of specialized agencies, administrative organizations under the People's Committee of the City, not specified or different from regulations in documents of higher-level state agencies; decide on renaming, adjusting the functions of existing specialized agencies, administrative organizations.
+ Regulate the establishment, reorganization, dissolution of specialized agencies, administrative organizations under the People's Committee of districts, district-level towns, cities under the City, not specified or different from regulations in documents of higher-level state agencies, based on the adjustment functions of the existing specialized agencies and administrative organizations, ensuring no overlap with the functions, tasks, authorities of other specialized agencies, administrative organizations, and aiming at rationalizing, streamlining, effective and efficient administrative reform. In cases of establishing additional agencies, the total number of specialized agencies under the People’s Committee of districts, district-level towns, cities under the City should not exceed 10% of the quantity set by the Government of Vietnam.
+ Determine the number of civil servants, public employees receiving salaries from the state budget managed by the City based on the list of job positions, population scale, actual workload, security, political, social safety characteristics in the area, and the budget balancing capabilities of the City, ensuring that the ratio of total staff to the total population does not exceed the national average ratio as decided by competent authorities.
+ Other tasks and authorities as regulated.
- Present to the Standing Board of the People's Council the following decisions:
+ Measures to address urgent and emergency tasks in disaster prevention, combating, dealing with the aftermath of natural disasters, epidemics, national defense, security, social order, and safety on the area
+ Adjust investment policies when necessary for B and C projects using public investment capital
+ Specific support as regulated at point d clause 1 of Article 35 of the 2024 Capital Law based on the annual budget approved by the People's Council of the City.
- Regulate the adjustment of job positions, official ranks, the structure of public employees according to job titles, fitting the functions, tasks, authorities, and organizational structure of agencies, organizations, and units under its management.
- Based on principles, conditions, and criteria for establishing public service providers as regulated by law, decide on establishing new public service providers under the management of the People's Committee of the City according to procedures set by the People's Council of the City.
- Other tasks and authorities as regulated.
