Nomination and Election of Delegates to the Superior Party Congress: Regulations and Procedures
Pursuant to Section 11.4 Regulation 24-QD/TW in 2021, Regulation on the implementation of the Charter of the Communist Party, accordingly:
1.4. (Clause 5): The nomination and election of delegates to the superior party congress.
11.4.1. Only official delegates of the congress are nominated to be elected as delegates to the superior party congress. When electing delegates to the representative congress of the superior party, the election list is a common list; officially elected delegates first, and the remaining number elects alternate delegates. In case the official delegate election has reached the required number but there are still some delegates receiving votes more than half of the total number of delegates or total party members convened, the alternate delegates are selected from these comrades according to the number of votes from high to low. If the required number of alternate delegates has not been elected according to regulations, whether or not to hold another election is decided by the congress.
Whether or not the subsequent election list introduces additional candidates outside the first election list is decided by the congress.
11.4.2. The conversion of alternate delegates to official delegates is decided by the standing committee of the party committee at the level convening the congress (at the Central level is the Politburo). This conversion must be reviewed by the delegate eligibility verification committee and reported to the congress for approval. Alternate delegates converted to official delegates in each party committee are according to the number of votes from high to low at that party representative congress. In case of equal votes, the one with a higher party age is selected.
11.4.3. After being elected, if an official delegate moves their work and party activities to a new unit, but the party organization at that new unit still belongs to the party committee convening the congress, that delegate is still convened to attend the congress; the party committee at the unit where the official delegate moved does not appoint an alternate delegate to replace; if the delegate has moved to a new unit where the party organization does not belong to the party committee convening the congress, that party organization can convert an alternate delegate to an official delegate to replace.
In case an official delegate (elected) requests not to attend the congress and is approved by the party committee convening the congress, an alternate delegate is appointed to replace.
11.4.4. An alternate delegate cannot replace an official delegate in the following cases:
a) The lower-level congress elects insufficient official delegates allocated.
b) The party committee member at the level convening the congress is absent for the entire congress time.
c) The official delegate's eligibility is disqualified.
An official delegate absent for the entire congress time without an alternate delegate to replace will not be counted in the total number of delegates convened for the congress when calculating election results.
11.4.5. In special cases where the party committee has elected delegates but then has a decision to split the party committee into several new party committees, the party committee convening the congress may decide to elect additional delegates for those new party committees in accordance with Clause 2, Article 11 of the Charter of the Communist Party on delegate allocation to affiliated party committees.
11.4.6. In cases where the party committee, sub-committee has organized the congress to elect delegates to the superior party committee congress but due to the requirement for division, the party committee, sub-committee is transferred to a new party committee and the new party committee has not yet held a congress, the party committee convening the congress has the responsibility to convene the delegates of the transferred party committee, sub-committee and count them in the total number of delegates convened for the congress.
