Mobile Police Entering Headquarters of Agencies, Organizations, Personal Residences for Counterterrorism and Hostage Rescue?
Can the Mobile Police enter the premises of agencies, organizations, and personal residences to combat terrorism and rescue hostages?
According to Article 13 of the Mobile Police Law 2022 (effective January 1, 2023) regarding entering the premises of agencies, organizations, and personal residences to combat terrorism and rescue hostages, the provisions are as follows:
The entry into the premises of agencies, organizations, and personal residences shall be conducted in accordance with the laws on counter-terrorism.
In cases where the premises belong to agencies or units under the management of the Ministry of National Defense, the entry shall comply with the regulations on coordination between the Ministry of Public Security and the Ministry of National Defense.
In cases involving the premises of diplomatic representative agencies, consular representative agencies of foreign countries, representative offices of international organizations, and residences of members of these agencies in Vietnam, the entry shall adhere to the laws of Vietnam and international treaties to which the Socialist Republic of Vietnam is a member.
What are the regulations on the operational measures of the Mobile Police?
Article 14 of this Law stipulates the operational measures of the Mobile Police as follows:
The Mobile Police shall implement operational measures in accordance with the Law on People's Public Security and other relevant legal provisions to fulfill the tasks and exercise the powers stipulated in Articles 9 and 10 of this Law, with the armed measures being the primary ones.
The Commander of the Mobile Police and the Director of Provincial Public Security shall decide the application of operational measures as specified in Clause 1 of this Article and shall be responsible before the law and their superiors for their decisions.
