Male Civil Servants Working in Especially Difficult Areas Since 2017: Are They Eligible for Initial Allowance Under Decree 76?
Decree 76/2019/ND-CP takes effect from December 1, 2019.
Officials and public employees,... upon first being assigned to work at agencies, organizations, and units in areas with especially difficult socio-economic conditions will receive a one-time allowance equivalent to 10 months of the statutory pay rate at the time of assignment. (Clause 1, Article 6, Decree 76/2019/ND-CP).
This provision is understood that from the effective date of this Decree, officials and public employees,... arriving to work in especially difficult areas will receive a one-time allowance.
According to the information you provided, you are an official who began working in an area with especially difficult socio-economic conditions from September 2017. Therefore, whether you are entitled to the one-time allowance will be considered under the regulations effective at that time, which is Decree 116/2010/ND-CP (effective until December 1, 2019).
To be eligible for the one-time allowance, a male official must have worked in an area with especially difficult socio-economic conditions for 5 years or more (Article 6, Decree 116/2010/ND-CP).
In your case, your work period in the especially difficult area extended from September 2017 to September 2020, hence you do not meet the eligibility condition for the one-time allowance under Decree 116/2010/ND-CP.
Combining the above-cited regulations, you are not eligible for the one-time allowance under Decree 76/2019/ND-CP, and you also do not meet the conditions for this allowance according to Decree 116/2010/ND-CP.
Respectfully!
