List of positions subject to and the time for periodic reassignment for officials and public employees who are not office holders in the financial sector as of June 17, 2024 in Vietnam

On May 3, 2024, the Minister of Finance issued Circular 27/2024/TT-BTC, which regulates the lis of positions subject to and the time for periodic reassignment for officials and public employees who are not office holders in the financial sector at the local government level.

The list of positions subject to periodic reassignment for officials and public employees who are not office holders in the financial sector includes:

(1) Budget allocation;

(2) Accounting, Chief Accountant;

(3) Public procurement;

(4) Appraisal, inspection, and settlement of funds as stipulated by the Law on State Budget 2015;

(5) Appraisal and valuation in auctions.

Note: The above list applies to officials and public employees who do not hold leadership or direct management positions and are involved in and handle tasks in the financial sector at agencies within the scope of managerial authority at the local government level.

The time for periodic reassignment is as follows:

- The periodic reassignment for officials and public employees directly involved in and handling tasks shall be conducted every 2 to 5 years as regulated (excluding the probationary period of officials and public employees).

- The starting point for calculating the time for periodic reassignment is the moment when the decision on transfer and assignment of tasks is made by the competent level according to the hierarchical management of personnel.

What are the cases not subject to periodic reassignment in the financial sector in Vietnam?

According to Article 4 of Circular 27/2024/TT-BTC, cases not subject to periodic reassignment in the financial sector include:

Cases not subject to periodic reassignment are specified in Article 38 of Decree 59/2019/ND-CP dated July 1, 2019, detailing certain articles and measures for the implementation of the Anti-corruption Law of the Government.

Therefore, cases not subject to periodic reassignment include:

- Individuals under disciplinary consideration or disciplinary action.

- Individuals under inspection, verification, auditing, investigation, prosecution, or trial.

- Individuals receiving treatment for serious illnesses as confirmed by authorized medical agencies; individuals attending centralized training for 12 months or more, or individuals on special assignment.

- Pregnant women or those nursing children under 36 months of age; men who are raising children under 36 months of age due to the loss of their wives or other objective circumstances.

What is the method of implementing the periodic reassignment in the financial sector in Vietnam?

According to Article 3 of Circular 27/2024/TT-BTC, the regulations on the method of implementing the periodic reassignment in the financial sector are as follows:

- The periodic reassignment is a part of personnel work under the leadership of the Party, particularly at the levels of CPV committees and Party organizations; It ensures the principles of concentrated democracy and emphasizes the collective responsibility of leadership bodies and heads of agencies.

-The Party Committee and the head of the agency must annually issue and publicly announce the plan for periodic reassignment. The plan shall clearly state the purpose, requirements, specific cases that require reassignment, the timeframe for implementation, the rights and obligations of individuals undergoing reassignment, and the organizational measures for implementation.

-The review and development of the plan for periodic reassignment are carried out in the first quarter of each year.

-The reassignment can occur within the same department, between different departments within the agency, between different fields or regions assigned for monitoring, taking responsibility, and managing, or between agencies within the scope of local government management.

- If an agency has only one position listed in the roster of positions subject to periodic reassignment, and that position has different professional and technical requirements compared to the remaining positions in that agency, the head of the higher-level agency directly establishes a general plan for the reassignment.

Note: Circular 27/2024/TT-BTC will come into effect from June 17, 2024.
