What are regulations on classification of administrative units in Vietnam?
Based on Article 3 of the Law on Organization of Local Government 2015 on the classification of administrative units:
Article 3. Classification of Administrative Units
- Classification of administrative units is the basis for planning economic - social development policies; building organizational machinery and policies for officials of local governments suitable to each type of administrative unit.
- Classification of administrative units must be based on criteria such as population size, natural area, number of subordinate administrative units, level of economic - social development, and the particular characteristics of each type of administrative unit in rural, urban, and island areas.
- Administrative units are classified as follows:
a) Hanoi City and Ho Chi Minh City are special category provincial-level administrative units; the remaining provincial-level administrative units are classified into three types: Type I, Type II, and Type III;
b) District-level administrative units are classified into three types: Type I, Type II, and Type III;
c) Commune-level administrative units are classified into three types: Type I, Type II, and Type III.
- Based on the provisions of Clauses 2 and 3 of this Article, the Government of Vietnam shall submit to the Standing Committee of the National Assembly the specific standards for each criterion, authority, and procedure for classifying administrative units.
What are principles for the delineation of the authority of local governments in Vietnam?
Based on Clause 2, Article 11 of the Law on Organization of Local Government 2015 (amended by Clause 4, Article 2 of the Law on Government and Law on Organization of Local Government Amendments 2019) on principles for the delineation of the authority of local governments in Vietnam:
- Ensuring unified state management of institutions, policies, strategies, and planning for sectors and fields; ensuring consistency and seamlessness of the national administrative system.
- Promoting the autonomy and self-responsibility of local governments in administrative units in performing state management tasks in the area as prescribed by law.
- Closely combining management by sector with territorial management, clearly defining state management tasks among local governments at all levels in relation to economic - social activities in the territorial area.
- The authority division must be suitable with the conditions, rural, urban, and island features and specificities of different sectors and fields.
- Issues related to the scope from two or more commune-level administrative units fall under the jurisdiction of the district-level governments.
- Issues related to the scope from two or more district-level administrative units fall under the jurisdiction of provincial-level governments.
- Issues related to the scope from two or more provincial-level administrative units fall under the jurisdiction of central government agencies, unless otherwise specified by law, resolutions of the National Assembly, orders, resolutions of the Standing Committee of the National Assembly, or decrees of the Government of Vietnam.
- The division of authority and decentralization for local government levels must ensure financial, human resources, and other necessary conditions; linking the division of authority and decentralization with the mechanism of inspection, supervision when implementing authority division and decentralization. Local governments perform the tasks and powers that have been assigned and bear responsibility within the scope of authority and decentralization.
