Latest Form of Disciplinary Action: Reprimand for Public Employees

Let me ask, in what cases will a public employee be disciplined with a reprimand? Please provide support according to the new regulations, thank you!

According to Article 16 of Decree 112/2020/ND-CP stipulating the application of the form of reprimand disciplinary action for public employees as follows:

The form of reprimand disciplinary action applies to first-time violations that cause minor consequences, except for violations specified in Clause 3, Article 17 of this Decree, falling under one of the following cases:

- Non-compliance with professional processes, regulations, professional ethics, and codes of conduct while performing professional activities, and has been reminded in writing by the competent authority;

- Violation of the legal regulations regarding: performing the responsibilities and duties of a public employee; labor discipline; regulations, internal rules, and working procedures of the public service provider, and has been reminded in writing by the competent authority;

- Abusing the working position for personal gain; having an arrogant, domineering attitude or causing difficulties or inconveniences for the people during the execution of assigned tasks; certifying or issuing legal documents to unqualified individuals; insulting the honor, dignity, or reputation of others while performing professional activities;

- Non-compliance with the work assignment decisions of the competent authority; not performing assigned duties without a legitimate reason; causing disunity within the unit;

- Violation of the legal regulations regarding: crime prevention; prevention of social evils; social order and safety; anti-corruption; practicing thrift and combating wastefulness;

- Violation of the legal regulations regarding the protection of state secrets;

- Violation of the legal regulations regarding complaints and denunciations;

- Violation of the legal regulations regarding: investment, construction; land, natural resources, and environment; finance, accounting, banking; management, and use of public assets during professional activities;

- Violation of the legal regulations regarding: prevention of domestic violence; population, marriage, and family.
