Jurisdiction to Determine State Secrets in the Police Force Belongs to Whom?
According to Clause 1, Article 3 of Circular 104/2021/TT-BCA (Effective from December 23, 2021) regarding individuals authorized to determine confidential documents within the Police, the provisions are as follows:
The head or authorized deputy of the People's Police unit that issues, disseminates the document, or creates a container holding state secrets is responsible for determining the state secrets and the level of secrecy of the state secrets.
The authorization to determine state secrets and the level of secrecy must be stipulated in the unit's internal regulations on protecting state secrets, working regulations, or the unit's annual work assignment document, clearly indicating the scope, content, and duration of the authorization.
Authorized deputies bear responsibility to their superiors and the law, and may not further delegate this authority to others.
