Issuance of Circular 03 on the delegation of certain state management tasks regarding beliefs and religions in Vietnam
On June 13, 2024, the Minister of Home Affairs issued Circular 03/2024/TT-BNV, which regulates the delegation of certain state management tasks regarding beliefs and religions.
Circular 03/2024/TT-BNV will take effect from July 30, 2024.
In Article 2 of Circular 03/2024/TT-BNV, the principles of delegation of state management regarding beliefs and religions are stipulated as follows:
- The delegation aims to meet the administrative reform requirements of the Government and ensure unified, comprehensive, effective and efficient state management of beliefs and religions by the Ministry of Home Affairs nationwide.
- Strengthening the inspection and examination of the responsibilities of the delegated agencies and organizations; clearly defining their tasks, authorities, capacity to carry out tasks, and enhancing the proactive role of the agency and its head; ensuring financial resources, human resources, and other necessary conditions to carry out the delegated tasks.
- Compliance with regulations when implementing the delegated contents and other relevant laws and regulations.

What are the contents for which the Government's Religious Affairs Board in Vietnam is delegated to receive notifications?
Based on Article 3 of Circular 03/2024/TT-BNV, which regulates the authority to receive notifications:
Authority to receive notifications
The Government's Religious Affairs Board is delegated the authority to receive notifications regarding the following contents:
1. Receiving notifications of ordination, appointment, election, selection, dismissal, and removal from positions:
a) Individuals who are ordained or selected for positions as specified in Article 33, Clause 1 of the Law.
b) Individuals who are appointed, elected, or selected for positions as specified in Article 34, Clause 1 of the Law.
c) Individuals who are appointed, elected, or selected for positions within certified religious organizations operating in multiple provinces.
d) Results of the appointment, election, or selection of leaders of organizations within certified religious organizations operating in multiple provinces, as specified in Article 34, Clause 7 of the Law.

Therefore, the Government's Religious Affairs Board is delegated the authority to receive notifications regarding the following contents:
- Receiving notifications of ordination, appointment, election, selection, dismissal, and removal from positions.
- Receiving notifications related to religious training institutions.
- Receiving notifications of the list of religious activities and the organization of annual conferences of religious organizations, subordinate religious organizations.
- Receiving notifications of changes in the headquarters of religious organizations, subordinate religious organizations operating in multiple provinces.
- Receiving notifications of the dissolution of religious organizations, subordinate religious organizations operating in multiple provinces; religious training institutions.
- Receiving notifications of the termination of affiliation with foreign religious organizations by religious organizations in Vietnam.
- Receiving notifications from religious organizations, subordinate religious organizations operating in multiple provinces regarding the receipt of funding from foreign organizations or individuals.
What are the contents for which the Government's Religious Affairs Board in Vietnam is delegated to approve or disapprove?
Based on Article 4 of Circular 03/2024/TT-BNV, which regulates that the Government's Religious Affairs Board is delegated the authority to approve or disapprove the following contents:
- Registering the certification of religious activities for organizations operating in multiple provinces.
- Registering the organization and amended regulations or admission regulations of religious training institutions.
- Registering individuals who are appointed, elected, or selected for positions as specified in Article 34, Clause 1 of the Law.
- Registering individuals who are appointed, elected, or selected for positions within certified religious organizations operating in multiple provinces.
- Requesting the organization of inter-religious conferences by religious organizations, subordinate religious organizations.
- Requesting the organization of congresses by religious organizations, subordinate religious organizations, certified religious organizations operating in multiple provinces.
- Registering Vietnamese citizens who are ordained, appointed, elected, or selected for positions abroad to return to Vietnam for positions and duties.
