Is There a Prison Sentence for Not Joining the Militia?
Pursuant to Article 21 of Decree No. 120/2013/ND-CP stipulating violations related to the organization of the militia and self-defense forces as follows:
- A fine ranging from VND 500,000 to VND 1,500,000 for acts of evading the obligation to participate in the core militia and self-defense forces.
- A fine ranging from VND 2,000,000 to VND 4,000,000 for acts of obstructing the construction of the militia and self-defense forces.
- A fine ranging from VND 4,000,000 to VND 6,000,000 for acts of not implementing the decision of the competent authority on the construction of the militia and self-defense forces.
- A fine ranging from VND 10,000,000 to VND 15,000,000 for acts of organizing the militia and self-defense forces illegally.
- Measures to remedy the consequences:
+ Compulsory implementation of the obligation to participate in the militia and self-defense forces for acts specified in Clause 1 of this Article;
+ Compulsory organization of militia and self-defense forces according to the decision of the competent authority for acts specified in Clause 3 of this Article;
+ Compulsory disbanding of the illegally organized militia and self-defense forces for acts specified in Clause 4 of this Article.
Thus, according to the current regulations, there are no provisions for imprisonment for evading participation in the militia and self-defense forces. However, there will still be a monetary fine along with the requirement to implement measures to remedy the consequences, which is the compulsory implementation of the obligation to participate in the militia and self-defense forces.
