Is the Commune Veterinarian Official?
Based on the provisions at Clause 1, Article 1 of the Law on Cadres, Officials and the amended Law on Public Employees 2019:
An official is a Vietnamese citizen, recruited and appointed into various ranks, positions, titles corresponding to job positions within agencies of the Communist Party of Vietnam, the State, and socio-political organizations at the central, provincial, and district levels; within agencies and units under the People’s Army that are not officers, professional military personnel, or defense workers; within agencies and units under the People’s Public Security that are not officers, non-commissioned officers serving under professional regimes, security workers, within the personnel establishment and receive salaries from the state budget.
At the same time, according to the provisions of Clause 2, Article 3 of Decree 92/2009/ND-CP, commune-level officials include the following titles:
- Head of Public Security;
- Chief of Military Command;
- Office - statistics;
- Land and Construction Management – Urban and Environment (for wards, commune-level towns) or Land – Agriculture – Construction and Environment (for communes);
- Finance – accounting;
- Justice – civil status;
- Culture – society.
Thus, combining the above two provisions, we see that the position of commune-level veterinary officer is not a commune-level official. Therefore, they are not entitled to the allowance policies for commune-level officials.
