I cannot be present to directly complain about an administrative decision at the People's Police, can I submit a complaint by post?
Pursuant to Article 4 of Circular 68/2013/TT-BCA regulating the receipt of complaints, recommendations and feedback as follows:
1. Complaints, recommendations, and feedback are received from the following sources:
a) Transmitted by Party and State leaders, National Assembly deputies, People's Council deputies, Vietnam Fatherland Front Committee and member organizations of the Front, press agencies and other agencies to comply with the provisions of law;
b) When an individual, agency or organization comes to the Police to complain directly (hereinafter referred to as the complainant);
c) Send via postal service and other sources.
2. Agencies, units and individuals, after receiving complaints, petitions, reports or documents recording the complaint content (hereinafter collectively referred to as applications) from the sources specified in Clause 1 of this Article, must record and enter into the computer database system for management and monitoring; Must stamp "To" and clearly state the date of receipt. The handling officer or person with authority to resolve is responsible for preserving, not damaging, losing, or changing the form and content of the application.
Thus, based on the above regulations in Vietnam, the complainant can go to the Police to complain directly or send it by post and other sources.
In case you cannot directly complain about an administrative decision at the Police Department, you can send a complaint by post to the Police Department with jurisdiction to resolve in Vietnam.
What is classification of complaints, petitions, and feedback in the People's Public Security in Vietnam?
Pursuant to Article 5 of Circular 68/2013/TT-BCA regulating classification of complaints, recommendations and feedback as follows:
1. Complaints about administrative decisions or administrative acts of agencies, units, officers, and soldiers of the Police means the complainant follows the procedures prescribed by the law on complaints and requests the agency or competent units and individuals in the People's Police shall review administrative decisions or administrative acts when there are grounds to believe that such administrative decisions or administrative acts are illegal or infringe upon the rights and interests of their legitimate interests.
2. Complaints about disciplinary decisions against officers, non-commissioned officers, soldiers serving for a limited period of time, students, and police workers (hereinafter collectively referred to as police officers and soldiers) are matters of officers and soldiers. Police officers, based on the regulations of the Ministry of Public Security and the procedures prescribed by the law on complaints, request competent agencies, units and individuals in the People's Police to review disciplinary decisions when there are grounds to believe that the decision is illegal and violates your legitimate rights and interests.
3. Complaints about policies, planning, appointment, mobilization, enrollment, recruitment, political standards, emulation and rewards (hereinafter referred to as complaints about policies) are Police officers and soldiers, based on the regulations of the Ministry of Public Security and the procedures prescribed by the law on complaints, request heads of agencies, units and competent individuals in the People's Police to consider decide on policies when there are grounds to believe that the decision is illegal, contrary to the regulations of the Ministry of Public Security, and infringes upon their legitimate rights and interests.
4. Complaints about decisions and acts of criminal proceedings means that the complainant, according to the procedures specified in Chapter XXXV of the 2003 Criminal Procedure Code, requests competent agencies, units and individuals in the Criminal Procedure Code. The People's Police shall review procedural decisions and procedural acts of agencies and persons with authority to conduct proceedings in the People's Public Security when there are grounds to believe that such decisions or acts are illegal or invasive their legitimate rights and interests.
5. Complaints about decisions and actions of agencies, units and individuals with authority to execute criminal judgments are matters of the person executing the criminal sentence and other relevant agencies, organizations and individuals according to procedures. The provisions of Section 1, Chapter has the authority to execute criminal judgments when there are grounds to believe that such decision or action is illegal and infringes upon one's legitimate rights and interests.
6. Recommendations and reflections are individuals, agencies, and organizations providing information, presenting opinions, aspirations, and proposing solutions to competent agencies, units, and individuals in the People's Public Security on issues related to the implementation of guidelines, legal policies, and management of areas under the responsibility of Police agencies and units.
