Is it possible to request leave from mandatory military service to take care of a wife giving birth?
According to the provisions of Point b, Clause 1, Article 50 of the 2015 Law on Military Service, non-commissioned officers and soldiers during their service from the 13th month onwards are entitled to leave according to policies; other cases of emergency leave are regulated by the Minister of National Defense.
Simultaneously, according to Article 3 of Decree 27/2016/ND-CP on the policies for leave for non-commissioned officers and soldiers serving in the military as follows:
Non-commissioned officers and soldiers serving in the military from the 13th month onwards are entitled to annual leave; the leave period is 10 days (excluding travel days) and they are paid for train, bus fares, and travel allowances according to current regulations.
Non-commissioned officers and soldiers who are students at academies, schools within or outside the Military, with a study period of one year or more and have summer vacation between two school years, this vacation time is counted as leave and they are paid for train, bus fares, and travel allowances according to current regulations.
...
- Non-commissioned officers and soldiers who have taken annual leave according to policies, if their family faces severe natural disasters, fires, or the death, disappearance of biological parents; parents-in-law; lawful caregivers; spouse and biological or adopted children, or the non-commissioned officers and soldiers have made exceptionally outstanding achievements in their duties, they are entitled to special leave, not exceeding 5 days (excluding travel days) and they are paid for train, bus fares, and travel allowances according to current regulations.
Thus, it can be seen that from the 13th month onwards, non-commissioned officers and soldiers serving in the military are eligible for annual leave. However, in your case, you have only served in the military for 6 months. Therefore, you do not qualify for leave according to the above policies.
Respectfully!
