Is it possible to register for the public employee recruitment while pregnant in Vietnam? Can I register for public employee recruitment after graduating from a pedagogical university with a combined degree in Vietnam? I'm 27 years old but I'm 3 months pregnant. In the countryside preparing to recruit public employee for the next school year, can I register for the civil service exam while I'm pregnant?

According to Article 22 of the Law on Public Employees 2010 as amended by Point a, Clause 12, Article 2 of the Law on Cadres and Civil Servants and the revised Law on Public Employees 2019, conditions for registration of public employee recruitment are as follows:

1 A person who meets all the following conditions, regardless of nationality, gender, social status, belief and religion, may register for public employee recruitment:

a/ Bearing Vietnamese citizenship and residing in Vietnam:

b/ Reaching full 18 years of age. For a number of areas of cultural activity, arts. physical training and spoils, the age eligible for recruitment may be lower as provided by law with written consent of at-law representatives:

c/ Filing an application for recruitment:

d/ Having a clear personal background;

e/ Possessing diplomas, training certificates or practice certificates or aptitude and skills relevant to the working position for which he/she applies:

f/ Being physically fit for work or tasks;

g/ Meeting other conditions required by the working position for which he/she applies and determined by the public non-business unit, which must not be contrary to law.

2. The following persons may not register for public employee recruitment:

a/ Having lost civil act capacity or having such capacity restricted;

b/ Being examined for penal liability; currently serving a criminal sentence or ruling of the court or serving the administrative measure of confinement to a medical treatment establishment, an educational institution or sending to compulsory detoxification establishments, sending to compulsory education establishments, sending to reformatories.

According to this Article, there are no regulations prohibiting pregnant women from taking the public employee exam. Therefore, if you are pregnant and meet the above conditions in Vietnam, you can register for the public employee exam.

Can I register for public employee recruitment after graduating from a pedagogical university with a combined degree in Vietnam?

I studied at Pedagogical University, majoring in physical education and defense education, which is a combined degree. So let me ask, am I qualified to take the exam to become a teacher teaching national defense and security education?

Pursuant to Article 20 of the Law on Public Employees 2010, which stipulates basis for recruitment of public employees, accordingly:

Recruitment of public employees must be based on work demand, working positions, criteria of professional titles and salary funds of public non-business units.

On the other hand, based on Article 5 of Decree 115/2020/ND-CP conditions for registering for public employee recruitment

- Conditions for registration are as prescribed in Article 22 of the Law on Public Employees. Agencies or units competent to recruit public employees specified in Clause 1, Article 24 of the Law on Public Employees may supplement with other conditions as required by the job positions specified at Point g, Clause 1, Article 22 of the Law on Public Employees, but must not be lower than common standards, must not be contrary to the provisions of the law, must not discriminate against the type of training.

- Persons applying for job positions in public non-business units in the fields of culture, art, physical training and sports may be younger than 18 years old but must be 15 years of age or older and have written consent from the legal representative.

Thus, based on the provisions of law in Vietnam, if you meet the conditions specified in Article 22 of the Law on Public Employees 2010 and the conditions supplemented by public service units, you are completely eligible to register for the exam as a teacher of national defense and security education.

I'm currently of the Kinh ethnic group and I'm doing the procedure to correct my ethnicity according to my mother's ethnicity as Hoa to facilitate the exam. Thus, the regulations on the conditions for recruitment of public employees, regardless of nationality or religion, are guaranteed to be fair and equal, all candidates have the same opportunity as together. The regulations on recruitment of public employees in Decree 115/2020/ND-CP also do not have any regulations allowing discrimination between ethnic groups in the process of recruiting and evaluating public employees in Vietnam.

Therefore, whether you are of Kinh or Hoa ethnicity does not affect your chances of taking the exam and passing the public employee exam.
