Is it possible to be appointed as department head if not elected as a member of the District People's Committee?
At Clause 2, Article 1 of Decree 108/2020/ND-CP, it is stipulated:
The head of the specialized agency under the district People's Committee (hereinafter commonly referred to as Head of Department), is a Member of the district People's Committee elected by the district People's Council, appointed by the Chairman of the district People's Committee, responsible to the district People's Committee, the Chairman of the district People's Committee, and the law for performing the functions, tasks, and powers of the department and executing the duties and powers of the Member of the district People's Committee according to the Working Regulations and assignment of the district People's Committee.
=> Thus, according to the above regulations, the head of the specialized agency under the district People's Committee called the head of department must be one of the Members of the district People's Committee elected by the district People's Council. Therefore, if a person is not elected as a Member of the district People's Committee, they do not meet the standards to be appointed as the head of department, the head of the specialized agency under the district People's Committee.
