Is it necessary to apologize to citizens and businesses and promptly address any delays or negativity in the processing of administrative procedures in Vietnam?
As prescribed in Clause 1 of Directive 27/CT-TTg in 2023, the Prime Minister of Vietnam requires government agencies to apologize to citizens if they experience delays or negativity in the processing of administrative procedures as follows:
Ministers, heads of ministerial-level agencies, agencies under the Government, and presidents of provincial People's Committees in central-affiliated cities shall focus on directing and organizing the implementation of the following:
...
dd) Strengthening administrative discipline and order in the reception and processing of administrative procedures and the provision of public services. Strictly implementing the reporting and explanation by the head of the agency, apologizing to citizens and businesses, and promptly addressing cases of delays or negativity in the processing of administrative procedures by the agency; implementing civil service inspection and inspection, and strictly handling agencies, units, officials, civil servants, and employees who engage in harassment, negativity, create additional administrative procedures, documents, and requirements that are not in accordance with regulations, or repeatedly cause delays in the reception and processing of administrative procedures.
Thus, to promptly rectify and overcome shortcomings and create favorable conditions in handling administrative procedures and providing public services to serve people and businesses, the Prime Minister has issued a request to direct that if delays or negative consequences occur in the handling of administrative procedures of agencies or units, they must apologize to people and businesses and promptly fix them.

What are prohibited acts in implementing administrative procedures in Vietnam?
Pursuant to Article 6 of the Decree 63/2010/NĐ-CP stipulating prohibited acts in implementing administrative procedures in Vietnam as follows:
1. Cadres and civil servants assigned to implement administrative procedures are prohibited from committing the following acts:
- Disclosing information on documentation and information relating to business know-how and personal secrets of administrative procedure-complying subjects that are known during the implementation of administrative procedures, unless such disclosure is consented by such subjects in writing or otherwise prescribed by law; using such information to infringe upon others legitimate rights and interests;
- Refusing to implement, prolonging the time of implementation or requiring other additional dossiers and papers than those prescribed at their own discretion without giving any reasons in writing:
- Acting in an authoritative, extortive and troubling manner towards administrative procedure-complying subjects; taking advantage of regulations and constraints related to administrative procedures for self-seeking purposes;
- Accepting money or gifts in any forms from administrative procedure-complying subjects upon receipt and handling of administrative procedures other than charges or fees for implementing administrative procedures which have been prescribed and made public;
- Shifting responsibility, showing lack of coordination, causing delays and obstacles in performing assigned tasks.
2. Administrative procedure-complying subjects are prohibited from obstructing activities of state agencies and competent persons; from giving bribes or using other expedients to deceive state agencies or competent persons in implementing administrative procedures.
3. Agencies, organizations and individuals are prohibited from committing acts that obstruct the control of administrative procedures.
What are principles of implementing administrative procedures in Vietnam?
Pursuant to Article 12 of the Decree 63/2010/NĐ-CP stipulating principles of implementing administrative procedures in Vietnam as follows:
- Ensuring the publicity and transparency of administrative procedures currently implemented.
- Ensuring objectivity and equality in implementing administrative procedures.
- Ensuring inter-agency transferability, timeliness, accuracy and convenience in implementing administrative procedures.
- Ensuring the right of individuals and organizations to give feedback and petitions on administrative procedures.
- Heightening the responsibility of cadres and civil servants in settling affairs for individuals and organizations.
