Answer: According to Clause 2, Article 5, Circular 148/2018/TT-BQP stipulates exemption from military conscription for the following citizens:
2. The following citizens shall have their conscription exempted:
a) Citizen who is a child of revolutionary martyrs or grade 1 wounded soldiers.
b) Citizen who is a brother of revolutionary martyrs.
c) Citizen who is a child of grade 2 wounded soldiers; a child of sick soldiers suffering labor capacity reduction of 81% or above; a child of people infected with dioxin and suffering labor capacity reduction of 81% or above.
d) Citizen who is carrying out cipher activities and not a soldier or police.
dd) Citizen who is an official or a youth volunteer assigned to an extremely disadvantaged socio-economic area according the law provisions for 24 months or more.
Thus, homosexual people are not in one of the cases exempted from military service. Because on your documents you are male, if you are eligible, you still have to perform military service according to regulations.

Answer: Pursuant to Appendix 1 Classification of health according to physical strength and diseases issued together with Joint Circular 16/2016/TTLT-BYT-BQP, there are provisions:
Curved spine:
- Stable (no progress, no fistula inflammation, pain): Score 4
- Affects carrying, moving, running and jumping: Score 5
- Severe: due to paralysis sequelae, trauma sequelae or spinal tuberculosis destroying vertebrae: Score 6
According to the provisions of Clause 4, Article 9 of Joint Circular 16/2016/TTLT-BYT-BQP, based on the score for 8 indicators recorded in the military service health card to classify the health of citizens participating in military service medical examination, specifically as follows:
- Type 1: 8 indicators all score 1;
- Type 2: There is at least 1 indicator with a score of 2;
- Type 3: There is at least 1 indicator with a score of 3;
- Type 4: There is at least 1 indicator with a score of 4;
- Type 5: There is at least 1 indicator with a score of 5;
- Type 6: There is at least 1 indicator with a score of 6.
Thus, a case of kyphosis will have health types 4, 5 and 6 in Vietnam.
And Point a, Clause 3, Article 4 of Circular 148/2018/TT-BQP has regulations on health requirements for military recruitment as follows:
3. Health requirements:
a) Draft citizens with health type 1, 2, 3 as specified in Joint Circular No. 16/2016/TTLT-BYT-BQP dated June 30, 2016 of the Minister of Health – the Minister of National Defense on provisions for pre-enlistment check-up.
Thus, from the above regulations in Vietnam, people with kyphosis are not physically qualified to participate in military service.
