Is an employee working at the Department of Information and Communications considered an official?

According to Clause 2, Article 4 of the 2008 Law on Public Officials, it is stipulated as follows:

Public official is a Vietnamese citizen, recruited, and appointed to a rank, position, or title within the agencies of the Communist Party of Vietnam, the State, political-social organizations at the central, provincial, and district levels; in agencies, units under the People's Army that are not officers, professional soldiers, or national defense workers; in agencies, units under the People's Public Security that are not officers, professional non-commissioned officers; and in the leadership and management apparatus of public service providers of the Communist Party of Vietnam, the State, political-social organizations (hereinafter collectively referred to as public service providers), on the payroll and receiving salaries from the state budget; for officials in the leadership and management apparatus of public service providers, salaries are ensured from the salary fund of the public service providers as stipulated by law.

Thus, if an employee is recruited or appointed to a rank or title in the Department of Information and Communications, they are considered a public official.
