Is an authorized person permitted to delegate authority for signing administrative documents?
According to Clause 3, Article 13 of Decree 30/2020/ND-CP:
- In special cases, the head of an agency or organization may delegate to the head of a subordinate agency, organization, or unit within their organizational structure the authority to sign certain documents that they themselves must sign.
- The delegation to sign under proxy must be done in writing, with limitations on time and content that is being authorized.
- The individual authorized to sign under proxy is not permitted to delegate that authority further to others. Documents signed under proxy must adhere to the format and bear the seal or digital signature of the delegating agency or organization.
=> Thus, in the case of proxy authorization, the individual authorized to sign under proxy is not allowed to delegate that signing authority further to others.
