I am a public employee currently working at a public service provider. According to the regulations, I am entitled to annual leave. However, due to my busy work schedule, I have not used all of my annual leave days. I would like to inquire whether these unused leave days can be compensated with monetary payment at the end of the year.[ Include the relevant legal references if any ]

Can public employees get paid for not taking all their annual leave days?

According to Article 13 of the Law on Public Employees 2010, the rights of public employees regarding time off are stipulated as follows:

  1. Entitled to annual leave, public holidays, and personal leave in accordance with labor law provisions. If, due to work demands, a public employee does not use or only partially uses their annual leave, they shall be paid a cash equivalent for the unused days.

  2. Public employees working in mountainous areas, border regions, islands, remote or isolated areas, or other special cases may, upon request, consolidate their leave days of 2 years into one continuous leave. Consolidating leave days of 3 years into one continuous leave requires the consent of the head of the public service provider.

  3. In specialized professional fields, public employees are allowed to take leave and receive salary according to legal regulations.

  4. Entitled to unpaid leave for legitimate reasons with the consent of the head of the public service provider.

Thus, according to current regulations, public employees shall be compensated with a cash payment for any unused or partially used annual leave days.

What are public employees prohibited from doing?

According to Article 19 of the Law on Public Employees 2010, the following are prohibited actions for public employees:

  1. Evading responsibility, shirking assigned work or tasks; engaging in factionalism, causing disunity; voluntarily quitting work; participating in strikes.

  2. Using the assets of agencies, organizations, units, and the public contrary to legal regulations.

  3. Discriminating based on ethnicity, gender, social class, belief, or religion in any form.

  4. Exploiting professional activities to propagate against the guidelines, policies of the Communist Party, laws of the State, or to harm the social ethics, customs, and the cultural and spiritual life of the people and society.

  5. Insulting the dignity, honor, or reputation of others in professional activities.

  6. Engaging in other prohibited actions as stipulated by the Law on Anti-Corruption, the Law on Thrift Practice and Waste Prevention, and other related legal regulations.
