Is a 16-year-old eligible to apply for a public employee position? Determining the successful candidate in the public employee recruitment exam when there are 02 candidates with the same score?
Can a 16-year-old apply for public employee recruitment?
According to Article 5 of Decree 115/2020/ND-CP, the conditions for registering for public employee recruitment are as follows:
The conditions for registration are implemented according to Article 22 of the Law on Public Employees 2010. Agencies or units authorized to recruit public employees as stipulated in Clause 1, Article 24 of the Law on Public Employees can add other conditions based on the requirements of the job position as specified in Point g, Clause 1, Article 22 of the Law on Public Employees. These additions must not be lower than the general standards, must comply with legal provisions, and must not discriminate based on the type of training.
Individuals registering for a job position in public service providers in the fields of culture, art, physical training, and sports may be younger than 18 but must be at least 15 years old and have written consent from their legal representative.
Therefore, under current regulations, a 16-year-old can apply for a position in a public service provider in the fields of culture, art, physical training, and sports, provided they have written consent from their legal representative.
Determining the successful candidate when two candidates have equal scores in the public employee recruitment exam?
According to Article 10 of Decree 115/2020/ND-CP, the determination of the successful candidate in the public employee recruitment exam is as follows:
- The candidate who passes the public employee recruitment exam must meet the following conditions:
a) Have a score of 50 or higher in the second round of the exam.
b) Have a total score in the second round plus any priority points as stipulated in Article 6 of this Decree (if any), arranged in descending order within the recruitment quota for each job position.
In the event that two or more candidates have the same total score as stipulated in Point b, Clause 1 of this Article for the last quota of the job position, the candidate with the higher score in the second round will be selected. If a decision still cannot be reached, the head of the agency or unit authorized to recruit public employees will decide the successful candidate.
Candidates who do not pass the public employee recruitment exam cannot retain their exam results for subsequent recruitment exams.
Therefore, in the case of two candidates having equal scores, the decision will be based on their results in the second round of the exam to determine the successful candidate.
Sincerely!
