Is 2 Degrees of Myopia Exempt from Military Service?
According to Clause 2, Article 41 of the 2015 Military Service Law, the following citizens are exempt from enlistment:
- Children of martyrs, children of first-class wounded soldiers;
- One brother or one sister of a martyr;
- One child of a second-class wounded soldier; one child of a sick soldier with a labor capability decrease of 81% or more; one child of a person exposed to Agent Orange with a labor capability decrease of 81% or more;
- Persons engaged in cryptographic work who are not military personnel, People's Police;
- Officials and public employees, young volunteers mobilized to work in areas with especially difficult socio-economic conditions according to the laws for 24 months or more.
Therefore, myopia does not fall under the cases exempt from enlistment.
According to Clauses 1 and 3, Article 4 of Circular 148/2018/TT-BQP which regulate recruitment standards as follows:
- Age:
+ Citizens from the age of 18 to the end of 25.
+ Male citizens who have been trained at college or university levels and have had their enlistment postponed during a training program of an educational level are selected and drafted until the age of 27.
- Health standards:
+ Selecting citizens with health categories 1, 2, 3 as stipulated in the Joint Circular No. 16/2016/TTLT-BYT-BQP dated June 30, 2016, of the Minister of Health and the Minister of National Defense regulating health examinations for military service performance.
+ For agencies, units, and positions specified at Point b, Clause 2 of this Article, selection is conducted to ensure special standards as prescribed by the Ministry of National Defense.
+ Do not enroll citizens with health category 3 refractive errors in the eyes (myopia of 1.5 diopters or more, hyperopia of various degrees); drug addiction, HIV, AIDS.
If you do not fall into the case of male citizens who have been trained at college or university levels and have had their enlistment postponed during a training program of an educational level, selected and drafted until the age of 27, then you have exceeded the enlistment age as regulated.
If you have 2 degrees of myopia, you are not called for enlistment according to Point c, Clause 3 of this Article.
If you have exceeded the regulated age or have undergone a health examination and received confirmation that you are exempt from enlistment due to 2 degrees of myopia but are still called for enlistment, you can file a complaint with the Chairman of the Commune People’s Committee for resolution according to the 2015 Military Service Law.
