In Vietnam, what does the application for permanent residence registration when buying an apartment include?
I have a permanent address in Binh Giang commune, Thang Binh district, Quang Nam province. I bought an apartment in Quang Trung ward, Vinh city, Nghe An province and have all the necessary documents for the purchase, trafer,... Can I register my permanent residence at the apartment address and what documents are required in the application?
Clause 1, Article 23 of the 2006 Law on Residence, supplemented and amended by Clause 3, Article 1 of the Law on Residence in 2013 stipulates as follows:
When a person who has a permanent residence moves from his or her lawful residence to a new lawful residences and meet the conditions for permanent residence registration, that person is responsible for following the procedure for changing the permanent residence within 12 months.
Point a, Clause 1, Article 6 of Decree 31/2014/ND-CP stipulates that papers and documents proving legal residence under the ownership of citizens are one of the following papers and documents:
- Certificate of ownership of a house or documents on the ownership of a house issued by the competent authority during different periods;
- Documents on land use rights according to the law on land (if there is a house on the land);
- Construction permit according to the construction law (if required);
- Sale and purchase contract of state-owned houses or documents on the valuation of state-owned houses;
- Purchase contract of a house or documents proving the handover and acceptance of a house from a business entity engaged in the construction and sale of houses;
- Notarized documents on the transfer, sale, gift, exchange, inheritance of a house by the People's Committee of the commune, ward, town (referred to as the commune People's Committee);
- Documents on the donation of houses for charity, solidarity, resettlement, or allocation of houses and land to individuals, households relocated according to the State's plan or other subjects;
- Documents from the Court or competent state administrative agencies confirming the ownership of a house that is legally effective;
- Confirmation from the commune People's Committee regarding the absence of disputes over the ownership or land use rights of a house if none of the above documents are available;
- Documents proving the registration of boats, ships, or other vehicles under ownership and the original port address of the vehicle used for residence. In case of no registration document, confirmation from the commune People's Committee is required regarding the ownership of the vehicle used for residence or confirmation of purchase, gift, exchange, inheritance of boats, ships, or other vehicles and the original port address of those vehicles.
Therefore, in your case, you can register your permanent residence at the address of the apartment because you have a house purchase contract, documents proving the handover and acceptance of the house from a business entity engaged in the construction and sale of houses according to the law. The dossier includes:
- Household registration form;
- Household registration change form;
- Household transfer document;
- Legal documents and papers proving the lawful residence.
