If I am have academic warnings more than once, will I be forced to leave school in Vietnam? If I am forced to leave university, will I not be able to postpone conscription in Vietnam? 

My name is Hung and I am 22 years old. Due to having academic warnings about my results many times, I was informed by the lecturer that if this semester I still fall under the academic warnings results, I will be forced to leave university. My question is, if I am forced to leave school now, the postponement of my military service will not be postponed anymore, right? What are regulations on academic warnings?

Pursuant to Article 11 of the Regulation on training at the university level promulgated together with Circular 08/2021/TT-BGDDT stipulating handling of credit-based academic performance as follows:

1. At the end of each main semester, students will receive an academic warning in any of the following cases:

a) Total number of failed credits in the semester exceeds more than half of the number registered for the semester or total number of failed credits from the beginning of the course is more than 24;

b) Semester average grade is under 0,8 for the first semester of the course or under 1,0 for following semesters;

c) GPA is under 1,2 for first-year students, under 1,4 for second-year students, under 1,6 for third-year students or under 1,8 for the following years.

2. Students will be forced to leave school in any of the following cases:

a) Number of academic warnings or level of academic warning received exceeds the permitted amount/ level according to regulations of the training institution;

b) Study duration exceeds the amount of time mentioned in Clause 5 Article 2 of this Regulation.

3. Training institution regulations shall provide for the following matters:

a) Application of some conditions for academic warning and permitted number of academic warnings or academic warning level, which shall allow for no more than 2 consecutive warnings;

b) Procedures for academic warning and forced leave from school; and announcement of such measures to students;

c) Retention of accumulated study results in case of forced leave from school.

Thus, according to the current regulations compared to the case you mentioned in Vietnam, you will be warned about your learning results when you meet the above conditions. Besides, according to the lecturer you mentioned, the number of times your academic warning when you exceed the limit can be forced to leave school is valid.

If I am forced to leave university, will I not be able to postpone conscription in Vietnam? 

In addition, in Clause 1, Article 41 of the 2015 Law on Military Service, the military service postponement is as follows:

1. These following citizens shall have conscription postponed:

a) Any citizen whose health is unsatisfactory for active duty military service according to the conclusion of pre-enlistment check-up board;

b) Any citizen being the sole earner who directly takes care of his/her relative who lost working capacity or under working age; any citizen being the sole earner in a family suffering serious damage to humans and properties due to dangerous accidents, disasters, epidemics certified by People’s Committees of communes;

c) Any citizen who is a child of sick soldiers, people infected with dioxin and suffering labor capacity reduction from 61% to 80%;

d) Any citizen whose full brother/sister is a non-commissioned officer/active duty enlisted soldier or a non-commissioned officer/enlisted soldier performing service in People’s Army;

dd) Any citizen who is subject to emigration or evacuation in 03 first years to extremely disadvantaged communes according to the socio-economic development project of the State that is decided by People’s Committees of provinces or higher levels;

e) Any citizen who is official or youth volunteer assigned to extremely disadvantage socio-economic area according to the law provisions;

g) Any citizen who is studying at compulsory education institutions or receiving training of university level at higher education institutions or training of college level at vocational education institutions for a training course of a level.

Thus, according to current regulations in Vietnam, in case you are forced to leave school, you are considered not in a regular university training program. As a result, you will no longer be able to postpone military service.
