How to Correct Information about Next of Kin on the Certificate of National Merit?
Based on Article 48 of Circular 05/2013/TT-BLDTBXH on the regulation of amending personal information in the records of individuals recognized by the state for their contributions:
- Applicability
Individuals recognized for their contributions to the revolution may request amendments to their surname, given name, middle name; date of birth, month, year of birth; place of origin; next of kin (collectively referred to as personal information) recorded in the records to match civil status documents.
- Principles of Amendment
The authority that issued the documents has the jurisdiction to amend them.
- Procedures for Resolution
+ For records managed by military or police authorities, the process follows the guidance of the Ministry of National Defense or the Ministry of Public Security;
+ For cases where the records are managed by the Department of Labor - Invalids and Social Affairs, the procedures are as follows:
Individuals recognized for their contributions, relatives of martyrs, or relatives of deceased individuals recognized for their contributions must submit a request for correction of information in the records (Form HS5) along with supporting documents to the Department of Labor - Invalids and Social Affairs that manages the original records.The Department of Labor - Invalids and Social Affairs, within 20 days from the date of receiving all required documents, is responsible for checking, comparing information, and providing documents for the correction of information to the competent authority. In case the issuing authority has been dissolved, the documents should be sent to the direct superior authority for review and resolution.The Department of Labor - Invalids and Social Affairs, based on the correction document from the competent authority, will adjust the information in the records of the individual and send the adjustment notification to the Ministry of Labor - Invalids and Social Affairs (Department of Persons with Meritorious Services).
Thus, in the case where personal information on the Certificate of National Contribution is incorrect, the responsible authority for the correction is the authority that issued the certificate above.
