Who shall be issued with an electronic identity account in Vietnam?

Pursuant to Article 11 of the Decree 59/2022/NĐ-CP stipulating subjects issued with an electronic identity account in Vietnam as follows:

- Vietnamese citizens aged 14 years or older; for Vietnamese citizens who are under 14 years old or are wards registered under the electronic identity accounts of their parents or guardians.

- Foreigners aged 14 years or older entering Vietnam; for foreigners who are under 14 years old or are wards registered under the electronic identity accounts of their parents or guardians.

- Agencies and organizations established or registered to operate in Vietnam.

When can a personal identification number replace a tax identification number (TIN) in Vietnam?

Pursuant to Clause 7 Article 35 of the Law on Tax Administration in 2019 stipulating use of TINs as follows:

6. When a Vietnamese party makes a payment to an organization/individual whose cross-border business is based on a digital intermediary platform outside of Vietnamese territories, it must use the TIN assigned to this organization/individual to deduct and pay tax on behalf of such organization/individual.

7. Personal identification numbers shall replace TINs when they are issued to the whole population.

How to cancel the issued personal identification number in Vietnam?

Pursuant to Article 16 of the Decree 137/2015/NĐ-CP stipulating cancellation of the issued personal identification number in Vietnam as follows:

Cancel the assigned personal identification number

1. When discovering that the issued personal identification number has errors due to incorrect information about citizens, the head of the management agency of the National Population Database of the Ministry of Public Security issues a decision to cancel that personal identification number and reissue another personal identification number to the citizen; Organize the adjustment of personal identification numbers and citizen information in the National Population Database, Citizen Identification Database and related records and archives.

2. The agency managing the National Population Database is responsible for notifying citizens and for civil status management and registration agencies to cancel and reissue citizens' personal identification numbers to carry out procedures to adjust relevant civil status documents and data; issue confirmation of cancellation and reissuance of personal identification numbers at the request of citizens, agencies and organizations.

Pursuant to Article 6 of the Circular 59/2021/TT-BCA stipulating cancellation and re-establishment of personal identification number as follows:

Cancellation and re-establishment of personal identification number

1. In case of re-establishment of personal identification number due to sex reassignment of citizens or correction of year of birth as per the law on civil registration, commune police where citizens register permanent residence shall request the citizens to provide civil status documents proving their sex reassignment or correction of year of birth to examine, verify and add to administrative documents and submit request for re-establishment of personal identification number to supervisory agencies of National database on population of Ministry of Public Security.

2. In case of cancellation of personal identification due to error relating to place of birth, year of birth, or gender of citizens during data input process, commune police where citizens register permanent residence must examine and verify information which needs revision and send request for cancellation and re-establishment of personal identification number to supervisory agencies of National database on population of Ministry of Public Security.

As regulations above, when discovering that the issued personal identification number has errors due to incorrect information relating to place of birth, year of birth, or gender of citizens, the procedures for cancellation of the issued personal identification number in Vietnam are as follows:

Step 1: Citizens shall notify errors to commune police where citizens register permanent residence and provide civil status documents as requested by the police authority to correct the information.

Step 2: Commune police where citizens register permanent residence must examine and verify information which needs revision and send request for cancellation and re-establishment of personal identification number to supervisory agencies of National database on population of Ministry of Public Security.

Step 3: The Ministry of Public Security considers canceling the incorrect personal identification number

Heads of supervisory agencies of National database on population of Ministry of Public Security are responsible for reviewing and deciding on cancellationof the incorrect personal identification number.

Once decisions on cancellation of personal identification number are issued, supervisory agencies of National database on population of Ministry of Public Security must update new personal identification number of citizens on the National database on population.

Cancelled personal identification number shall be stored in information data of citizens in the National database on population and must not be issued to other citizens.

Step 4: Notifying the citizens

Commune police where citizens register permanent residence shall inform the citizens in writing about their new personal identification number.

Step 5:

Police authorities that receive application for issuance of Citizen Identity Cards shall utilize newly established personal identification number in the National database on population to issue Citizen Identity Cards as per the law.
