How long is the probation period for a Grade IV nurse?

Nurses are identified as public employees according to the regulations in Joint Circular 26/2015/TTLT-BYT-BNV.
Clause 2 Article 6 of Joint Circular 26/2015/TTLT-BYT-BNV requires the qualifications and training for the rank IV nursing title specifically as follows:
“Graduate from intermediate level or higher in nursing. In the case of graduating from an intermediate level in midwifery or medical technician, a training certificate in nursing as regulated by the Ministry of Health is required.”
Regarding the probationary period, according to Clause 11 Article 2 of Decree 161/2018/ND-CP, the probationary period for public employees is stipulated as follows:
- 12 months for those recruited into a professional title requiring university-level educational standards. Particularly for the professional title of doctor, the period is 09 months;
- 09 months for those recruited into a professional title requiring college-level educational standards;
- 06 months for those recruited into a professional title requiring intermediate-level educational standards.
Combining the two above regulations, rank IV nursing is a professional title requiring an intermediate level or higher in nursing training. Thus, the probationary period for rank IV nursing public employees is 6 months.
Clause 11 Article 2 of Decree 161/2018/ND-CP also stipulates:
The time off for maternity leave according to social insurance benefits, the time off for illness from 14 days or more, the time off without pay, the time being detained, held in custody, or suspended from work according to the provisions of law are not included in the probationary period.
Thus, if you take sick leave for less than 14 days during the probationary period, it will still be counted as part of the probationary period.
