How long is the actual professional working time to appoint a medical expert in Vietnam?

Based on Clause 1 Article 2 of Circular 02/2014/TT-BYT, some contents were abolished by Clause 2 Article 9 Circular 06/2019/TT-BYT regulating the standards for appointing medical experts and medical psychiatric experts as follows:

1. Vietnamese citizens residing in Vietnam who meet the standards specified in Clause 1 Article 7 of the Judicial Expertise Law, not falling under the cases specified in Clause 2 Article 7 of the Judicial Expertise Law, and meeting the specific standards below shall be appointed as medical experts and medical psychiatric experts:

a) The standard "having a university degree or higher" specified in Point b Clause 1 Article 7 of the Judicial Expertise Law is as follows: For medical experts, they must be medical doctors, pharmacists with a university degree, or graduates with a university degree in other relevant fields suitable for the Judicial Expertise sector; for medical psychiatric experts, they must be medical doctors who have undergone specialized training in psychiatry or higher;

b) The standard "having practical experience in the trained field" specified in Point b Clause 1 Article 7 of the Judicial Expertise Law is the time working in the correct field trained at a healthcare facility for at least 05 years. In cases where the person proposed to be appointed as a medical expert or medical psychiatric expert is directly involved in the forensic activities at the forensic or forensic psychiatric organization, the actual professional working time must be at least 03 years;

c) Certificate "having undergone training or refresher courses in Judicial Expertise" specified in Point c Clause 1 Article 7 of the Judicial Expertise Law.

According to this Article, the actual professional working time in the trained field for at least 03 years is required for the case of appointing a medical expert who directly assists in the forensic activities at the forensic organization. The working time in the trained field for other cases is the time working in the correct field trained at a healthcare facility for at least 05 years.

Is a certificate of training in forensic examination abroad considered for appointment as a medical expert in Vietnam?

Clause 2, Article 2 of Circular 02/2014/TT-BYT stipulates as follows:

A university degree or higher, a certificate of having undergone training or refresher courses in Judicial Expertise issued by foreign educational institutions must be recognized in Vietnam in accordance with the laws on education or international treaties of which the Socialist Republic of Vietnam is a member.

Therefore, a certificate of having undergone forensic examination training abroad must be recognized in Vietnam according to the above regulations to be considered for appointment as a medical expert.
