How long must a university graduate complete probation to become a public employee? Does a probationary employee receive 100% of the salary and allowances equivalent to their training level?
After graduating in Accounting from university, I applied for the position of Accountant at a state agency and am currently a probationary public employee there for 2 months. I am wondering how much longer I have to complete the probation period to become an official public employee. Pursuant to Clause 2, Article 21 of Decree 115/2020/ND-CP on probation policies. To be specific:
- The probation period is prescribed as follows:
a) 12 months for those recruited into professional titles requiring a university degree. For the professional title of a doctor, it is 09 months;
b) 09 months for those recruited into professional titles requiring a college degree;
c) 06 months for those recruited into professional titles requiring an intermediate level of education.
d) The time off for maternity leave according to social insurance benefits, sick leave of 14 days or more, unpaid leave, the period of temporary detention, custody, or suspension from work according to the provisions of law is not counted as part of the probation period.
In cases where the probationary person is sick or has a legitimate reason for less than 14 days and is approved by the head of the public service provider where the recruited person is undergoing probation policies, this time will be counted as part of the probation period.
Thus, in your case, having already completed 02 months of probation, you must undergo an additional 10 months of probation before being officially recruited as a public employee.
Do probationers enjoy 100% salary and allowances equivalent to their educational level?
According to Clause 2, Article 23 of Decree 115/2020/ND-CP on policies towards probationers and probationary instructors, it is stipulated as follows:
- Probationers shall enjoy 100% of the salary and allowances of the professional title corresponding to their educational level prescribed in Clause 1 of this Article in the following cases:
a) Working in areas with especially difficult socio-economic conditions;
b) Working in hazardous and dangerous professions;
c) Completing military service; participating in the people's police service; officers of the army, officers of the police, professional soldiers returning to civilian life, cryptographic officers changing sectors, graduates of reserve officer training, graduates of commune-level military command training who are awarded the rank of reserve officer and have registered as reserve officers, young volunteer teams, and young intellectual volunteers participating in rural and mountain development for at least 24 months and who have completed their missions.
You are only entitled to 100% of the salary and allowances of the professional title corresponding to your educational level as prescribed in Clause 1 of this Article in the cases mentioned above.
