How is the Secondment of Officials Regulated?
The secondment of officials is stipulated in Article 27 of Decree 138/2020/ND-CP, specifically:
- The secondment of officials is carried out in the following cases:
+ For urgent and pressing tasks;
+ To perform work that needs to be resolved within a specified period.
- The duration of the secondment of officials shall not exceed 03 years, except in cases implemented as per the specialized legal provisions.
- An official who is seconded is subject to the assignment, arrangement, evaluation, and inspection of the performance of tasks by the agency or organization to which they are seconded, but still belongs to the personnel of the agency or organization that sent the secondment, including cases where the official holds a leadership or management position and is seconded to hold an equivalent leadership or management position to the current one.
- Authority for the secondment of officials:
The head of the agency or organization assigned and decentralized to manage the officials shall decide on the secondment of officials under their management authority or submit it to the competent authority for decision according to the provisions of law.
- Procedures for the secondment of officials:
+ The head of the agency or organization assigned and decentralized to manage the officials where the official works and the destination of the secondment shall exchange and unify opinions in writing;
+ The head of the agency or organization where the official is working decides according to their authority or submits it to the competent authority for decision according to the management decentralization.
- Before deciding on the secondment of officials, the head of the agency or organization assigned and decentralized to manage the officials should meet with the officials, clearly stating the purpose and necessity of the secondment to listen to the official’s opinions before deciding according to their authority or reporting to the competent authority for consideration and decision.
