How is the Initial Information Collection on Traffic Accidents Regulated?
The collection of initial information pertaining to a traffic accident is stipulated in Clause 5, Article 7, Circular 63/2020/TT-BCA. To be specific:
- Observe to detect and collect evidence that is easily alterable or likely to be lost; note any changes that affect the scene during the process of rescuing the victims;
- Locate the vehicle operators and persons related to the traffic accident; inspect and temporarily confiscate documents of individuals and vehicles related to the traffic accident;
- Identify witnesses and individuals with knowledge of the accident to collect information about the traffic accident (if there are any, record their full names, addresses, phone numbers, ID card numbers, or Citizen Identification numbers);
- Utilize professional technical equipment provided to the Traffic Police to immediately check the blood alcohol concentration or other prohibited stimulants of the vehicle operators involved in the traffic accident at the scene or request medical facilities to check the blood alcohol concentration of the vehicle operators involved in the accident being treated;
- Examine and collect electronic data through the Traffic Police Surveillance System; request cooperation from agencies, organizations, and individuals to provide electronic data from journey monitoring devices attached to vehicles passing through the accident scene or images from cameras of agencies, organizations, and individuals around the scene during the time the traffic accident occurred (if any).
