How is the classification adjustment of state secret-containing documents regulated?
According to Article 11 of Circular 38/2020/TT-BCA (Effective from July 1, 2020), regulations on adjusting the confidentiality level of documents containing state secrets are stipulated as follows:
Adjusting confidentiality level refers to the increase or decrease of an already determined level of state secrets.
The adjustment of confidentiality level must be based on the list of state secrets issued by the Prime Minister of the Government of Vietnam in the fields of national security, public order and safety, and other fields specified in the Law on Protection of State Secrets.
The head of a People's Public Security unit who determines the confidentiality level of state secrets is authorized to decide on the adjustment of the confidentiality level of state secrets.
After issuing the decision to adjust the confidentiality level, the People's Public Security unit that adjusts the confidentiality level must stamp or have a document or other form identifying the increase or decrease of the confidentiality level.
No later than 15 days from the date the authorized person specified in Clause 3 of this Article decides to adjust the confidentiality level, the People's Public Security unit adjusting the confidentiality level must notify in writing the relevant agencies, organizations, and individuals.
The People's Public Security unit receiving the notification of the confidentiality level adjustment is responsible for stamping or having a document or other form identifying the corresponding adjustment of the confidentiality level for the state secret within its management scope.
- The form of the confidentiality adjustment stamp is implemented according to the regulations in Circular No. 24/2020/TT-BCA dated March 10, 2020, issued by the Minister of Public Security on issuing forms used in the work of state secret protection.
